【摘要】：近年來(lái)，當(dāng)事人在婚姻存續(xù)期間不起訴離婚而單獨(dú)訴求分割夫妻財(cái)產(chǎn)之情形日益增多，《婚姻法司法解釋?zhuān)ㄈ返谒臈l以《物權(quán)法》第九十九條為依據(jù)，在國(guó)內(nèi)明確了夫妻婚內(nèi)共同財(cái)產(chǎn)分割制度。在國(guó)內(nèi)確立該制度，既有其必要性，亦存在可行性，但仍未完善。本文結(jié)合法理分析和案例考察對(duì)這一制度進(jìn)行探討，認(rèn)為：一、婚內(nèi)共同財(cái)產(chǎn)分割應(yīng)遵循如下基本原則：夫妻共同財(cái)產(chǎn)在婚姻關(guān)系存續(xù)期間一般不得分割；保障弱勢(shì)方利益；其他具體原則。二、婚內(nèi)共同財(cái)產(chǎn)分割適用條件為：夫妻一方故意減少夫妻共同財(cái)產(chǎn)；一方負(fù)有法定扶養(yǎng)義務(wù)的人患有重大疾病不醫(yī)治。三、婚內(nèi)共同財(cái)產(chǎn)的分割方式主要有：實(shí)物分割，變價(jià)分割，價(jià)格補(bǔ)償?shù)确指罘绞健６鄶?shù)國(guó)家婚內(nèi)財(cái)產(chǎn)分割需以分別財(cái)產(chǎn)判決（非常財(cái)產(chǎn)制）為前提。四、完善婚內(nèi)共同財(cái)產(chǎn)分割制度，可借鑒國(guó)外相關(guān)制度，，參考實(shí)行分別財(cái)產(chǎn)制中適合中國(guó)社會(huì)發(fā)展的實(shí)際情形，對(duì)《婚姻法司法解釋?zhuān)ㄈ返谒臈l所規(guī)定的夫妻婚內(nèi)共同財(cái)產(chǎn)分割兩大情形予以具體說(shuō)明，如扶養(yǎng)人之范圍、重大疾病之范圍、醫(yī)療費(fèi)用之?dāng)?shù)額等；還需增加夫妻一方或雙方債權(quán)人之請(qǐng)求權(quán)，或一方依法被宣告失蹤而另一方不申請(qǐng)離婚單獨(dú)要求分割財(cái)產(chǎn)情形等規(guī)定。
[Abstract]:In recent years, the cases of the parties who do not sue for divorce and separate the property of husband and wife are increasing day by day. The judicial interpretation of the Marriage Law (3) > 4th is based on the 99th articles of the Real right Law. It is necessary and feasible to establish this system in China, but it is still not perfect. This paper discusses this system by combining legal theory analysis and case study. The division of joint property within marriage should follow the following basic principles: the common property of husband and wife shall not be divided generally during the marriage relationship; the interests of the vulnerable party shall be safeguarded; and other specific principles. The applicable conditions for the division of joint property within marriage are as follows: one of the spouses intentionally reduces the joint property of the husband and wife; the person who has the legal obligation to support the couple suffers from major diseases and does not heal; third, the division of the common property in the marriage mainly includes: physical division, The division of marital property in most countries should be based on the judgment of separate property (extraordinary property system). Fourth, to perfect the system of division of common property in marriage, we can learn from the relevant systems of foreign countries. Referring to the actual situation in the implementation of the separate property system suitable for the development of China's society, the article (3) > 4th of the Marriage Law provides a specific description of the two major circumstances of the division of marital joint property, such as the scope of the dependant, The scope of the major illness, the amount of medical expenses, etc., and the need to increase the claim of one spouse or the creditors of both parties, or the case where one party is declared missing according to law and the other party does not apply for divorce to separate the division of the property.
