【摘要】：隨著人權(quán)意識的增長,人們對自己的生活方式擁有了越來越多的自由選擇,非婚同居這種原先被包含在非法同居概念中的生活方式,現(xiàn)在也已經(jīng)得到人們的認(rèn)可,成為了一種普遍存在的社會現(xiàn)象,并且這種現(xiàn)象正在不斷的增加當(dāng)中,然而就在其存在和不斷增加的過程中,發(fā)生了一系列的社會問題,例如本文案例中涉及到的人身關(guān)系問題和財產(chǎn)問題,由于法律在這方面的空白,使得社會問題越來越嚴(yán)重,我認(rèn)為現(xiàn)在中國已經(jīng)是法治國家,許多問題應(yīng)該是通過法律解決的,并且有的專家也指出“事實上,同居同樣需要保護(hù),不論它是雙方締結(jié)婚姻的前奏還是試圖脫離婚姻的最終選擇。”所以寫此論文對中國在非婚同居這方面的法律建設(shè)提一點(diǎn)建議。本文主要是在研究前人學(xué)術(shù)成果的基礎(chǔ)上,針對現(xiàn)實問題進(jìn)行分析,并借鑒外國的立法經(jīng)驗,結(jié)合我國的立法現(xiàn)狀,提出相關(guān)立法建議。 本文是一篇案例分析題材的論文,通過對幾個非婚同居案例的分析,來找出非婚同居中存在的急需要通過法律手段來解決的問題,主要內(nèi)容包括以下四個部分。 第一部分用了四個案例來引出非婚同居關(guān)系存在的各種問題,主要包括人身關(guān)系問題和財產(chǎn)關(guān)系問題。其中人身關(guān)系又包括身份權(quán)確認(rèn)難,扶養(yǎng)請求權(quán)、侵害賠償請求權(quán)無法律依據(jù),一對一的公平合理配對權(quán)無法律保障,子女撫養(yǎng)權(quán)雖有規(guī)定但非婚子女身心極易受侵害；財產(chǎn)關(guān)系又包括財產(chǎn)分割平等權(quán)不能保障,想取得財產(chǎn)繼承權(quán)無法律依據(jù)。 第二部分主要是寫非婚同居法律問題亟待解決的原因,一、導(dǎo)致了各種刑事犯罪的頻繁發(fā)生,極具社會危害性；二、大量學(xué)者贊同非婚同居立法的各種觀點(diǎn)；三、尊重人權(quán)、保障人權(quán)的體現(xiàn)；四、法律完善的要求。 第三部分是對非婚同居問題的處理現(xiàn)狀進(jìn)行研究：主要分析了我國現(xiàn)有法律對非婚同居的相關(guān)規(guī)定和外國法律對非婚同居的法律規(guī)定,對中國的法律現(xiàn)狀做了描述,并對大陸法系和英美法系的代表國家對非婚同居的法律處理現(xiàn)狀做了分析,為下一章的法律構(gòu)想做鋪墊。 第四部分是本文的寫作目的,也是文章最重要的部分,本部分主要通過對中國的立法現(xiàn)狀特別是借鑒婚姻法的規(guī)定和借鑒外國的處理方式,來構(gòu)思了中國法律關(guān)于非婚同居的條文設(shè)計。對案例中產(chǎn)生的問題一一提出解決的法律條文建議,主要包括人身關(guān)系問題和財產(chǎn)關(guān)系問題。其中人身關(guān)系又包括身份權(quán),扶養(yǎng)請求權(quán)、侵害賠償請求權(quán),公平合理配對權(quán),子女撫養(yǎng)權(quán)；財產(chǎn)關(guān)系又包括財產(chǎn)分割平等權(quán),財產(chǎn)繼承權(quán)。
[Abstract]:With the increasing awareness of human rights, people have more and more freedom to choose their own way of life, non-marital cohabitation, which was originally included in the concept of illegal cohabitation. Now has also been recognized as a universal social phenomenon, and this phenomenon is constantly increasing, but in the process of its existence and increasing. A series of social problems have occurred, such as the personal relationship and property problems, which are involved in the case of this paper. Because of the blank of the law in this respect, the social problems become more and more serious. I think China is already a country ruled by law, many problems should be solved by law, and some experts also point out, "in fact, cohabitation also needs protection." Whether it is a prelude to a marriage or an attempt to break away from the marriage. " So write this paper in China in the non-marital cohabitation of the legal construction of some suggestions. This paper is mainly based on the previous academic achievements. This paper analyzes the practical problems, draws lessons from foreign countries' legislative experience, and puts forward some relevant legislative suggestions according to the present situation of our country's legislation. This paper is a case analysis of the subject matter through the analysis of several cases of non-marital cohabitation to find out the urgent need to solve the problems in non-marital cohabitation through legal means. The main content includes the following four parts. The first part uses four cases to lead to various problems of non-marital cohabitation relationship, mainly including personal relationship and property relationship. There is no legal basis for the right to claim compensation for infringement, and there is no legal guarantee for the right of fair and reasonable matching of one to one. The right of custody of children is stipulated, but the children who are not married are extremely vulnerable to infringement. The property relationship includes the equal right of division of property, and there is no legal basis to obtain the right of inheritance. The second part is mainly about the reasons why the legal problems of non-marital cohabitation need to be solved. Firstly, it leads to the frequent occurrence of various criminal crimes, which is extremely harmful to society. Second, a large number of scholars agree with the various views of non-marital cohabitation legislation; Third, to respect human rights and guarantee the embodiment of human rights; Fourth, the law consummation request. The third part is to deal with the status quo of non-marital cohabitation: mainly analyzes the existing laws of China and foreign law on non-marital cohabitation related provisions. This paper describes the current legal situation of China, and analyzes the legal treatment of non-marital cohabitation in the representative countries of the continental law system and the common law system, paving the way for the legal conception in the next chapter. Part 4th is the purpose of this article and the most important part of the article. This part is mainly through the legislative situation of China, especially the provisions of the Marriage Law and the treatment of foreign countries. To conceive the Chinese law on non-marital cohabitation provisions design. To the case of the problems one by one proposed to solve the legal provisions of the proposal. It mainly includes personal relationship and property relationship, in which personal relationship includes status right, right to claim for maintenance, right to claim compensation for infringement, right of fair and reasonable match, right of custody of children; Property relations also include the right to equal division of property, property inheritance rights.
