【摘要】：立法目的是指國家在制定或認可法律時希望達到的目的或希望實現的結果。立法目的決定立法的指導思想和法律的調整對象，屬于法基本問題的范疇。明確法的目的，有利于我們正確理解立法意圖、正確理解和執(zhí)行法律。本文通過對環(huán)境應急立法目的的研究，旨在厘清各種基本概念的基礎上，對現行應急法律及相關文件予以檢討，從而提出更為科學合理的環(huán)境應急立法目的，為環(huán)境應急單行法的制定提供理論支持。 本論文分為四個部分。第一部分是環(huán)境應急立法目的概述，對突發(fā)事件、突發(fā)環(huán)境事件以及突發(fā)環(huán)境事件應急三者的概念予以明晰，層層遞進，在參考前人的基礎上提出本文的看法。在這一部分對立法目的也作了一簡要介紹。 第二部分是對現行環(huán)境應急立法的探討。討論了《突發(fā)事件應對法》在規(guī)制環(huán)境應急方面的局限性以及立法的成功經驗，為環(huán)境應急立法目的的確定打下基礎；對《國家突發(fā)環(huán)境事件應急預案》的性質與效力進行了分析，，認為其不屬于法律法規(guī)，不具有嚴格的法律效力，但也吸收了該預案在理論和實務上的成功經驗，對我們環(huán)境應急立法目的的確立具有重要的參考價值。 第三部分，探討了制定環(huán)境應急單行法的必要性。在對學界觀點揚棄的基礎上，指出環(huán)境應急單行法不僅是環(huán)境應急法制體系建設的要求，同時也是環(huán)境應急實踐的要求。 第四部分是本文的重點，也是主要創(chuàng)新之所在。提出環(huán)境應急立法目的在于突出預防、保障安全和維護秩序，對預防、安全和秩序進行了詳細探討，并在形式上提出了環(huán)境應急立法目的。
[Abstract]:The purpose of the legislation is to refer to the purpose of the state in making or recognizing the law. The purpose of the legislation is to determine the guiding ideology and the object of the law, which belongs to the category of the basic legal issues. The purpose of the clear law is beneficial to our understanding of the legislative intent and the correct understanding and enforcement of the law. This article passes through the ring. The purpose of environmental emergency legislation is to make a review of the current emergency laws and related documents on the basis of clarifying the basic concepts, so as to provide a more scientific and rational environmental emergency legislative purpose and to provide theoretical support for the formulation of environmental emergency single line law.
This paper is divided into four parts. The first part is an overview of environmental emergency legislative purposes. The concept of emergency, sudden environmental events and emergency environmental emergencies of the three are clear and progressive, and the views of this article are put forward on the basis of the predecessors. In this part, the purpose of the legislation is also briefly introduced.
The second part is the discussion of the current environmental emergency legislation. The limitations of the emergency response law and the successful experience of the legislation are discussed, and the basis for the determination of environmental emergency legislative purposes is laid. The nature and effectiveness of the emergency plan for environmental emergencies in the state are analyzed, and it is considered that it does not belong to the law. Laws and regulations do not have strict legal effect, but they also absorb the successful experience of the plan in theory and practice, and have important reference value for the establishment of our environmental emergency legislative purpose.
In the third part, the necessity of establishing an environmental emergency single line method is discussed. On the basis of the discarding of the academic views, it is pointed out that the environmental emergency single line method is not only the requirement of the construction of environmental emergency system, but also the requirement of environmental emergency practice.
The fourth part is the focus of this article and also the main innovation. The aim of environmental emergency legislation is to highlight prevention, safeguard safety and maintain order, discuss the prevention, safety and order in detail, and put forward the legislative purpose of environmental emergency in form.
