公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)法律制度研究

【摘要】:我國正在進(jìn)行社會(huì)主義現(xiàn)代化建設(shè),各種各樣的建設(shè)項(xiàng)目對整個(gè)國民經(jīng)濟(jì)的發(fā)展中其至關(guān)重要的作用,但是建設(shè)項(xiàng)目在發(fā)展經(jīng)濟(jì)的同時(shí),對生態(tài)環(huán)境的破壞程度是前所未有的。為了使建設(shè)項(xiàng)目的效果實(shí)現(xiàn)經(jīng)濟(jì)發(fā)展、社會(huì)進(jìn)步和環(huán)境保護(hù)三者協(xié)調(diào)統(tǒng)一,避免“市場失靈”和“政府失靈”,我們應(yīng)該做好環(huán)境影響評價(jià)工作。對建設(shè)項(xiàng)目進(jìn)行環(huán)境影響評價(jià)時(shí),公眾參與是環(huán)境影響評價(jià)中的重要內(nèi)容。它能使建設(shè)單位、政府與公眾三者之間的利益達(dá)到平衡,從而能實(shí)現(xiàn)生態(tài)環(huán)境的最大保護(hù)。在我國現(xiàn)有的有關(guān)公眾參與的法律法規(guī)和學(xué)者研究的基礎(chǔ)上,應(yīng)當(dāng)更好的完善公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)法律制度,使該制度達(dá)到應(yīng)有的效果。 本文共包括五部分:導(dǎo)論、正文三章和結(jié)語。 第一部分,介紹了公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)的概念。在本章中重點(diǎn)介紹了建設(shè)項(xiàng)目環(huán)境影響評價(jià)的概念、公眾參與的不同定義方式,以及各種不同定義方式的比較分析,還介紹了公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)的內(nèi)涵。以及筆者為什么選取建設(shè)項(xiàng)目環(huán)境影響評價(jià)作為公眾參與的范圍而不是整個(gè)環(huán)境影響評價(jià)領(lǐng)域,分析了公眾參與到建設(shè)項(xiàng)目環(huán)境影響評價(jià)對于環(huán)境保護(hù)的意義。并且從我國環(huán)境管理制度、經(jīng)濟(jì)發(fā)展的考核方式的關(guān)系、公眾自身的原因以及環(huán)境影響評價(jià)機(jī)構(gòu)存在的問題等幾個(gè)方面宏觀分析了我國公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)效果羸弱的原因。 第二部分,概括分析我國公眾參與建設(shè)項(xiàng)目環(huán)境保護(hù)的現(xiàn)狀及存在的問題。在本章中,作者歸納了我國有關(guān)公眾參與建設(shè)項(xiàng)目環(huán)境影響評價(jià)的立法現(xiàn)狀,歸納出我國公眾參與建設(shè)項(xiàng)目環(huán)境保護(hù)中存在主要法律問題。這部分主要從如要構(gòu)架一個(gè)高效的法律制度必須關(guān)注的幾個(gè)方面:有明確的法律目標(biāo),明確的參與主體,有合理的公眾參與方式,有完善的權(quán)利行使的程序,對相關(guān)主體權(quán)利的救濟(jì)方式和法律責(zé)任的承擔(dān)。并從這幾個(gè)方面檢視我國現(xiàn)有的制度,歸納出我國主要存在的問題。 第三部分,設(shè)想完善我國公眾參與建設(shè)環(huán)境影響評價(jià)法律制度。這章內(nèi)容主要是結(jié)合第二部分提出的一些問題,尋求解決這些問題的辦法,這些辦法包括確定公眾資格和范圍,統(tǒng)一信息的公開程序,完善信息的雙向交流方式,明確主體的權(quán)利和義務(wù),完善公眾參與的法律責(zé)任和法律救濟(jì),設(shè)置吸引公眾參與的獎(jiǎng)勵(lì)措施。
[Abstract]:Our country is carrying on the socialist modernization construction, all kinds of construction projects play an important role in the development of the whole national economy, but the construction projects in the development of the economy at the same time, the destruction of the ecological environment is unprecedented. In order to achieve economic development, social progress and environmental protection, and avoid "market failure" and "government failure", we should do a good job of environmental impact assessment. Public participation is an important part of environmental impact assessment for construction projects. It can balance the interests of the construction unit, the government and the public, thus realizing the maximum protection of the ecological environment. On the basis of the existing laws and regulations on public participation and the research of scholars, we should perfect the legal system of environmental impact assessment of public participation in construction projects, so that the system can achieve its due effect. This paper consists of five parts: introduction, three chapters and conclusion. The first part introduces the concept of public participation in environmental impact assessment of construction projects. In this chapter, the concept of environmental impact assessment of construction project, the different definition ways of public participation, and the comparative analysis of different definition ways are introduced, and the connotation of public participation in environmental impact assessment of construction project is also introduced. And why the author chooses the environmental impact assessment of construction project as the scope of public participation rather than the whole field of environmental impact assessment, and analyzes the significance of public participation in environmental impact assessment of construction project for environmental protection. And from the relationship between China's environmental management system and the assessment mode of economic development, The reasons for the weakness of the public participation in the environmental impact assessment of construction projects in China are analyzed in several aspects, such as the reasons of the public itself and the problems existing in the environmental impact assessment institutions. The second part analyzes the current situation and existing problems of public participation in environmental protection of construction projects in China. In this chapter, the author sums up the current legislative situation of public participation in environmental impact assessment of construction projects in China, and concludes that there are main legal problems in public participation in environmental protection of construction projects in China. This part is mainly from several aspects that we must pay attention to if we want to construct an efficient legal system: there are clear legal objectives, clear participants, reasonable ways of public participation, perfect procedures for the exercise of rights. The relief method and the legal responsibility of the right of the relevant subject. And from these aspects to examine the existing system of our country, summed up the main problems in our country. The third part is about perfecting the legal system of public participation in environmental impact assessment. The main content of this chapter is to find solutions to the problems raised in the second part, which include determining the public qualification and scope, unifying the open process of information, and perfecting the two-way exchange of information. Make clear the rights and obligations of the subject, perfect the legal responsibility and legal relief of public participation, and set up incentive measures to attract public participation.
