【摘要】：風險預防原則作為一項重要的環(huán)境保護原則,它的國際地位已經(jīng)得到迅速提升,該原則試圖在人類健康、經(jīng)濟發(fā)展、社會進步和環(huán)境保護之間達到一種合理的平衡狀態(tài)。人類的發(fā)展必須依靠環(huán)境的保護,人類與環(huán)境的相互作用定會給環(huán)境帶來相應的影響,而良好的環(huán)境是人類從事一切活動的基礎。所以,為了解決日益嚴重和復雜的環(huán)境問題,世界各國都在以各種方式積極應對這一全球性問題,風險預防原則就是在這一特定的歷史條件下產(chǎn)生并發(fā)展的。現(xiàn)今,國際上多數(shù)國家和地區(qū)已經(jīng)就環(huán)境風險從立法等多方面著手確立了“風險預防原則”,多種國際公約均主張在處理與環(huán)境有關的問題時,應考慮以實現(xiàn)最大限度的保護環(huán)境利益為首要因素。我國政府向來十分重視維護良好的環(huán)境,為實現(xiàn)我國憲法第二十六條的規(guī)定：“國家保護和改善生活環(huán)境和生態(tài)環(huán)境,防治污染和其他公害”,為保護公民的生存環(huán)境,在我國確立該原則是勢在必行的。 筆者認為,世界各國普遍關注全球性的環(huán)境風險問題,而發(fā)達國家更是逐漸擴大了風險預防原則的適用范圍,給我國經(jīng)濟社會的發(fā)展帶來了雙重影響。目前,我國尚未將風險預防原則作為基本的環(huán)境保護原則納入環(huán)境保護立法體系,特別是在全球化問題多樣以及國際貿(mào)易迅猛發(fā)展的今天,面對新型的國際貿(mào)易壁壘等問題我國總是因沒有明確的法律規(guī)范而處于不利的地位,因此我國必須從立法、執(zhí)法與司法等方面確立該原則的重要地位。本文先以概述的形式介紹風險預防原則的發(fā)展過程及其基本特點,進而對風險預防原則的概念和適用條件進行闡述。然后,圍繞風險預防原則在我國確立的必要性和可行性以及如何確立進行重點論述。最后,指出該原則在我國環(huán)境保護立法中確立需注意的問題。環(huán)境的惡化具有持續(xù)性,惡化的后果具有滯后性和不可逆轉(zhuǎn)性,就此諸多領域都對風險預防原則的重要性予以認可,并在積極地探索正確適用這一原則的有效方法,因此,該原則在我國環(huán)境保護立法中的確立與適用同樣意義重大而深遠。
[Abstract]:As an important principle of environmental protection, the principle of risk prevention has been rapidly promoted in the international position, which attempts to achieve a reasonable balance between human health, economic development, social progress and environmental protection. The development of human beings must depend on the protection of the environment. The interaction between human beings and the environment will bring the corresponding influence to the environment, and a good environment is the basis of all human activities. Therefore, in order to solve the increasingly serious and complex environmental problems, all countries in the world are actively dealing with this global problem in various ways. The principle of risk prevention is born and developed under this particular historical condition. Nowadays, most countries and regions in the world have established the "principle of risk prevention" from many aspects, such as legislation and so on, and many international conventions advocate that when dealing with problems related to the environment, Consideration should be given to achieving maximum environmental benefits as the primary factor. Our Government has always attached great importance to the preservation of a good environment, in order to realize the provisions of Article 26 of our Constitution: "the State protects and improves the living environment and the ecological environment, controls pollution and other public hazards", and in order to protect the living environment of citizens, It is imperative to establish this principle in our country. The author thinks that all countries in the world pay attention to the problem of global environmental risk, and developed countries have gradually expanded the scope of application of the principle of risk prevention, which has brought double influence to the economic and social development of our country. At present, China has not incorporated the principle of risk prevention as a basic principle of environmental protection into the legislative system of environmental protection, especially at a time when the globalization problem is diverse and the international trade is developing rapidly. In the face of new international trade barriers and other problems, our country is always in a disadvantageous position because of the lack of clear legal norms, so we must establish the important position of this principle from the aspects of legislation, law enforcement and judicature. This paper first introduces the development process and basic characteristics of the risk prevention principle in the form of an overview, and then expounds the concept and applicable conditions of the risk prevention principle. Then, the necessity and feasibility of establishing the principle of risk prevention in our country and how to establish it are discussed emphatically. Finally, the paper points out that the principle should be paid attention to in the legislation of environmental protection in China. The deterioration of the environment is sustainable, and the consequences of deterioration are lagging and irreversible. In this regard, the importance of the principle of risk prevention is recognized in many fields, and effective methods for its correct application are actively explored, therefore, The establishment and application of this principle in China's environmental protection legislation is equally significant and far-reaching.
