城市生活垃圾污染防治法律問(wèn)題研究

【摘要】: 隨著我國(guó)經(jīng)濟(jì)的發(fā)展和居民生活水平的提高,我國(guó)生活垃圾的產(chǎn)生量急劇增長(zhǎng),垃圾成份也發(fā)生了顯著的變化。目前,我國(guó)生活垃圾存在著清運(yùn)不及時(shí)、運(yùn)輸不衛(wèi)生、處理不科學(xué)、回收不規(guī)范等現(xiàn)狀,垃圾問(wèn)題不僅嚴(yán)重影響了環(huán)境衛(wèi)生和人們的身體健康,而且造成了大量資源的浪費(fèi)。我國(guó)現(xiàn)有的生活垃圾管理體制是計(jì)劃經(jīng)濟(jì)的產(chǎn)物,多年來(lái)一直將垃圾的管理作為一種社會(huì)福利事業(yè)來(lái)進(jìn)行,存在著“政企合一”,調(diào)節(jié)手段單一,缺乏效率等弊端;同時(shí)一,雖然我國(guó)新修訂了《中華人民共和國(guó)固體廢物污染環(huán)境防治法》,初步建立了生活垃圾污染防治的法律、法規(guī)體系,但仍存在著立法的盲區(qū),缺少相應(yīng)的配套法規(guī),無(wú)法對(duì)垃圾污染進(jìn)行全過(guò)程法律規(guī)制。因此,立足于我國(guó)的現(xiàn)實(shí)情況,適當(dāng)借鑒國(guó)外發(fā)達(dá)國(guó)家在生活垃圾的管理和立法上的先進(jìn)經(jīng)驗(yàn),重新構(gòu)建我國(guó)生活垃圾的管理體制和完善我國(guó)生活垃圾污染防治立法勢(shì)在必行。首先,應(yīng)建立與市場(chǎng)經(jīng)濟(jì)相適應(yīng)的管理體制,明確政府職能,營(yíng)造良好的市場(chǎng)秩序,大力推進(jìn)生活垃圾的產(chǎn)業(yè)化、民營(yíng)化,實(shí)行垃圾收費(fèi)制度,鼓勵(lì)公眾積極參與。其次,以循環(huán)經(jīng)濟(jì)為我國(guó)生活垃圾污染防治立法的指導(dǎo)思想,在立法中貫徹生活垃圾減量化、無(wú)害化、資源化原則,制定各項(xiàng)配套法律、法規(guī),提高法律的可操作性,完善我國(guó)生活垃圾污染防治法體系。
[Abstract]:With the development of our country's economy and the improvement of the living standard of our country, the production of domestic garbage has increased rapidly, and the composition of garbage has also changed significantly. At present, the domestic garbage in our country has the status quo of untimely transportation, unsanitary transportation, unscientific treatment and non-standard recovery, etc. The garbage problem not only seriously affects the environmental hygiene and people's health, but also causes the waste of a large number of resources. The existing domestic waste management system in our country is the product of planned economy. For many years, the management of garbage has been carried out as a social welfare undertaking, which has the disadvantages of "integration of government and enterprise", single means of regulation, lack of efficiency, etc. At the same time, Although China has newly revised the Law of the people's Republic of China on the Prevention and Control of solid waste pollution, and has preliminarily established a system of laws and regulations for the prevention and control of domestic waste pollution, there are still blind areas for legislation, and the corresponding supporting laws and regulations are lacking. The whole process of garbage pollution can not be regulated by law. Therefore, it is imperative to re-establish the management system of domestic waste and perfect the legislation of domestic waste pollution prevention and control in our country, based on the reality of our country and draw lessons from the advanced experience of domestic waste management and legislation of developed countries. First of all, we should establish a management system adapted to the market economy, clarify the functions of the government, create a good market order, vigorously promote the industrialization of domestic waste, privatize, implement the garbage charging system, and encourage the public to participate actively. Secondly, take recycling economy as the guiding ideology of domestic garbage pollution prevention and control legislation, implement the principle of reducing, harmless and resource of domestic garbage in the legislation, formulate various supporting laws, laws and regulations, and improve the operability of laws. Improve the domestic garbage pollution prevention and control law system.
