【摘要】：環(huán)評(píng)制度自20世紀(jì)70年代施行以來(lái),在預(yù)防環(huán)境污染和生態(tài)破壞、促進(jìn)可持續(xù)發(fā)展戰(zhàn)略的實(shí)施方面發(fā)揮了重要作用,但是該制度施行過(guò)程中也存在一些問(wèn)題,引發(fā)了社會(huì)的關(guān)注甚至質(zhì)疑。本文就環(huán)評(píng)監(jiān)管法律機(jī)制的困境及其原因進(jìn)行分析,研究探討環(huán)評(píng)制度以審批制為核心調(diào)整為以環(huán)評(píng)文件質(zhì)量管理為核心的必要性和可行性,并以環(huán)評(píng)文件質(zhì)量管理為核心,提出完善環(huán)評(píng)管理措施與環(huán)評(píng)文件質(zhì)量責(zé)任,充分征求公眾意見(jiàn),加強(qiáng)環(huán)評(píng)事中事后監(jiān)管,以及完善環(huán)評(píng)監(jiān)管法律機(jī)制的對(duì)策建議。
[Abstract]:Since its implementation in the 1970s, the EIA system has played an important role in preventing environmental pollution and ecological destruction and promoting the implementation of the strategy of sustainable development. However, there are still some problems in the implementation of the system. Has aroused the social concern and even questions. This paper analyzes the predicament of the legal mechanism of environmental impact assessment supervision and discusses the necessity and feasibility of the adjustment of the environmental impact assessment system from the examination and approval system to the quality management of the environmental impact assessment documents, and the quality management of the environmental assessment documents as the core. The paper puts forward some countermeasures and suggestions to perfect the management measures and the quality responsibility of the EIA documents, to solicit public opinions, to strengthen the supervision after the EIA, and to perfect the legal mechanism of the EIAs supervision.
