【摘要】：我國新近出臺的《循環(huán)經(jīng)濟(jì)促進(jìn)法》只規(guī)定了以企業(yè)和政府為主體所應(yīng)承擔(dān)的循環(huán)經(jīng)濟(jì)法律責(zé)任,且以行政責(zé)任為主要的內(nèi)容,涉及民事責(zé)任的只有兩條,即第五十五條規(guī)定“違反本法規(guī)定,電網(wǎng)企業(yè)拒不收購企業(yè)利用余熱、余壓、煤層氣以及煤矸石、煤泥、垃圾等低熱值燃料生產(chǎn)的電力的,由國家電力監(jiān)管機(jī)構(gòu)責(zé)令限期改正；造成企業(yè)損失的,依法承擔(dān)賠償責(zé)任。”；第五十六條規(guī)定“違反本法規(guī)定,有下列行為之一的,由地方人民政府工商行政管理部門責(zé)令限期改正,可以處五千元以上五萬元以下的罰款；逾期不改正的,依法吊銷營業(yè)執(zhí)照；造成損失的,依法承擔(dān)賠償責(zé)任。而涉及到刑事責(zé)任的承擔(dān)只有第五十七條：“違反本法規(guī)定,構(gòu)成犯罪的,依法追究刑事責(zé)任�！睂τ诠褙�(zé)任,法律沒有規(guī)定,理論界研究也比較少。 法律責(zé)任的承擔(dān)對于法律功能的實(shí)現(xiàn)非常重要。對循環(huán)經(jīng)濟(jì)責(zé)任的研究,不僅是對循環(huán)經(jīng)濟(jì)法律制度的補(bǔ)充,對于循環(huán)經(jīng)濟(jì)的建設(shè)有了實(shí)質(zhì)性的法律保障。由于循環(huán)經(jīng)濟(jì)促進(jìn)法是政策性傾向的法律,本文對循環(huán)經(jīng)濟(jì)行政法律責(zé)任做了著重的研究,同時對于民事責(zé)任的和刑事責(zé)任在循環(huán)經(jīng)濟(jì)中的運(yùn)用作了解讀,初步構(gòu)建起了以行政責(zé)任為主的循環(huán)經(jīng)濟(jì)法律責(zé)任體系。
[Abstract]:The newly promulgated Circular economy Promotion Law of our country only stipulates the legal liability of circular economy which should be assumed by enterprises and governments, and takes administrative liability as the main content, only two articles involving civil liability. That is, the provisions of Article 55 that "in violation of the provisions of this Law, power grid enterprises refuse to purchase the use of residual heat, residual pressure, coal-bed methane and coal gangue, slime, garbage and other low-calorific value fuel production of electricity, the State Power Regulatory Agency ordered to correct within a time limit;" Whoever causes losses to an enterprise shall be liable for compensation according to law. "Article 56 provides that" whoever commits any of the following acts in violation of the provisions of this Law shall be ordered by the administrative department for industry and commerce of the local people's government to make corrections within a time limit, " May impose a fine of not less than 5,000 yuan and not more than 50,000 yuan; if no correction is made within the time limit, the business license shall be revoked according to law; if losses are caused, the party shall bear the liability for compensation according to law. The only thing that involves criminal responsibility is Article 57: "if a crime constitutes a crime in violation of the provisions of this Law, criminal responsibility shall be investigated according to law." For the citizen responsibility, the law does not stipulate, the theory circle research is also relatively few. The assumption of legal responsibility is very important to the realization of legal function. The research on the responsibility of circular economy is not only a supplement to the legal system of circular economy, but also a substantial legal guarantee for the construction of circular economy. Because the circular economy promotion law is the law of policy tendency, this article has made the emphatically research to the circular economy administrative legal liability, at the same time has made the interpretation to the civil liability and the criminal responsibility in the circular economy application, The system of legal responsibility for circular economy has been preliminarily constructed with administrative responsibility as the main part.
