【摘要】： 隨著世界經(jīng)濟(jì)全球化進(jìn)程的加快,國(guó)際貿(mào)易不斷擴(kuò)張,環(huán)境與貿(mào)易的沖突日益顯現(xiàn)。國(guó)際貿(mào)易自由化制度和規(guī)則可以從多方面直接或間接影響環(huán)境,近年來(lái)不斷出現(xiàn)的由國(guó)際貿(mào)易引發(fā)的環(huán)境爭(zhēng)議基本都具體引用了WTO框架下的綠色條款。因此,研究這些綠色條款,為識(shí)別貿(mào)易保護(hù)手段,積極應(yīng)對(duì)綠色壁壘,為達(dá)到國(guó)際標(biāo)準(zhǔn)而努力創(chuàng)新,提升本國(guó)企業(yè)競(jìng)爭(zhēng)力都有著重要的意義。本文首先從WTO多邊貿(mào)易體制下的綠色條款的產(chǎn)生背景開(kāi)始分析,介紹了環(huán)境與貿(mào)易的關(guān)系,以及貿(mào)易與環(huán)境談判的發(fā)展趨勢(shì)。其次重點(diǎn)分析了WTO的主要綠色條款,并結(jié)合經(jīng)典案例分析了WTO爭(zhēng)端解決機(jī)構(gòu)對(duì)這些條款的具體條文的解釋,以便以后我國(guó)遇到類似案件具有預(yù)測(cè)力。最后,本文結(jié)合我國(guó)環(huán)境立法的具體現(xiàn)狀,結(jié)合前文對(duì)WTO綠色條款的分析,對(duì)我國(guó)與貿(mào)易相關(guān)的環(huán)境立法提出了幾點(diǎn)立法建議。
[Abstract]:With the acceleration of the globalization of the world economy and the expansion of international trade, the conflict between environment and trade is becoming increasingly apparent. The system and rules of international trade liberalization can directly or indirectly affect the environment in many aspects. In recent years, the environmental disputes caused by international trade have basically quoted the green clauses under the framework of WTO. Therefore, it is of great significance to study these green clauses, to identify the means of trade protection, to actively deal with green barriers, to strive for innovation to meet international standards, and to enhance the competitiveness of domestic enterprises. This paper first analyzes the background of green clause under the multilateral trading system of WTO and introduces the relationship between environment and trade and the development trend of trade and environment negotiation. Secondly, the main green clauses of WTO are analyzed, and the interpretation of these articles by the WTO dispute settlement body is analyzed in combination with the classical cases, so that the similar cases in our country will have predictive power in the future. Finally, this article combines the concrete situation of our country's environmental legislation, combines the previous analysis to the green clause of WTO, and puts forward some legislative suggestions to our country's environmental legislation related to trade.
