【摘要】：環(huán)境污染不僅對(duì)人類(lèi)生存的環(huán)境造成惡劣的影響,還會(huì)給人們的健康和財(cái)產(chǎn)帶來(lái)嚴(yán)重的損害,2007年我國(guó)環(huán)保部、衛(wèi)生部等共18個(gè)部委局辦聯(lián)合發(fā)布了《國(guó)家環(huán)境與健康行動(dòng)計(jì)劃(2007-2015)》,該計(jì)劃是我國(guó)環(huán)境與健康領(lǐng)域的第一個(gè)綱領(lǐng)性文件,說(shuō)明國(guó)家對(duì)環(huán)保事業(yè)的發(fā)展和人類(lèi)健康的保護(hù)愈來(lái)愈重視,讓飽受環(huán)境健康侵?jǐn)_和即將遭遇環(huán)境威脅的人們看到了希望。在國(guó)家對(duì)環(huán)境侵權(quán)事前預(yù)防做的越來(lái)越到位的背景下,筆者將視角主要轉(zhuǎn)向環(huán)境污染侵害人們健康的事后救濟(jì)上,即對(duì)環(huán)境健康司法救濟(jì)進(jìn)行全面追蹤,細(xì)致地闡述司法實(shí)踐中存在的不足和亟待改進(jìn)的地方,尤其針對(duì)實(shí)踐中的難點(diǎn)和鮮有人討論的空白區(qū)進(jìn)行重點(diǎn)思考和設(shè)計(jì),試圖從根本上解決司法救濟(jì)中存在的主要問(wèn)題,幫助公民挽回曾在環(huán)境污染面前丟失的健康權(quán),盡最大可能地全面救濟(jì)受害人遭受的環(huán)境健康侵害。 對(duì)此,本文先對(duì)各種基本概念進(jìn)行理解和界定,通過(guò)數(shù)據(jù)顯示環(huán)境糾紛的急劇上升和環(huán)境司法救濟(jì)不足之間的強(qiáng)烈反差,進(jìn)而通過(guò)典型案例說(shuō)明環(huán)境污染所致健康損害司法救濟(jì)的困難和現(xiàn)狀,分析其存在的問(wèn)題和原因,再通過(guò)和國(guó)外相關(guān)理論和經(jīng)驗(yàn)進(jìn)行比較之后,從立法和制度兩方面提出了完善和提高我國(guó)環(huán)境污染所致健康損害司法救濟(jì)的相應(yīng)建議。文章主要包括引言、正文、結(jié)論三大部分,共有四個(gè)章節(jié): 第一部分引言:筆者通過(guò)眾多鮮活的例子揭示出我們生活的世界普遍遭到環(huán)境污染的侵襲,對(duì)人們的身心健康產(chǎn)生了巨大威脅,環(huán)境健康問(wèn)題不容小覷;接著道出環(huán)境侵害健康的實(shí)質(zhì)是公民的基本權(quán)利—健康權(quán)被侵害;最后敘述本文的主要研究目的。 第二部分正文,共四章,研究的內(nèi)容包括:第一章“對(duì)基本概念的理解和界定”:對(duì)文章標(biāo)題涉及的關(guān)鍵詞如“環(huán)境污染”、“健康損害”和“司法救濟(jì)”進(jìn)行概念解釋和范圍限定,通過(guò)與其它救濟(jì)方式的比較,強(qiáng)調(diào)司法救濟(jì)的重要性。第二章“我國(guó)環(huán)境污染所致健康損害司法救濟(jì)的現(xiàn)狀及存在的問(wèn)題”:通過(guò)幾則典型案例反映出我國(guó)環(huán)境污染健康損害司法救濟(jì)的現(xiàn)狀,分析我國(guó)司法救濟(jì)中存在的主要問(wèn)題和問(wèn)題產(chǎn)生的原因。第三章“國(guó)外環(huán)境污染所致健康損害司法救濟(jì)相關(guān)理論和制度的考察及對(duì)我國(guó)的借鑒”:對(duì)國(guó)外主要的環(huán)境污染所致健康損害司法救濟(jì)相關(guān)理論和制度進(jìn)行考察和比較,并分析其對(duì)我國(guó)的借鑒。第四章“完善我國(guó)環(huán)境污染所致健康損害司法救濟(jì)的建議”:從立法和制度兩方面提出具體的完善我國(guó)環(huán)境污染所致健康損害司法救濟(jì)的措施。 第三部分結(jié)論:總結(jié)文章的創(chuàng)新之處,指出其存在的不足,期待以后該方面的理論和制度會(huì)更加完善。
[Abstract]:Environmental pollution not only has a bad effect on the living environment of human beings, but also brings serious damage to people's health and property. In 2007, the Ministry of Environmental Protection of our country,The Ministry of Health and other departments and offices jointly issued the National Environment and Health Action Plan 2007-2015, which is the first programmatic document in the field of environment and health in China.It shows that the country pays more and more attention to the development of environmental protection and the protection of human health, so that people who suffer from environmental health problems and are about to encounter environmental threats see hope.Under the background that the country has done more and more to prevent the environmental tort in advance, the author mainly turns the angle of view to the relief after the environmental pollution infringes people's health, that is, to track the judicial relief of the environmental health comprehensively.Expatiating on the shortcomings and the urgent improvement in the judicial practice, especially focusing on the difficult points in practice and the blank area that few people discuss, in order to solve the main problems in the judicial relief fundamentally.To help citizens recover the right to health that has been lost in the face of environmental pollution, and to fully relieve the victims of environmental health violations as far as possible.In this paper, the basic concepts are first understood and defined, and the data show the sharp contrast between the sharp rise of environmental disputes and the shortage of environmental judicial relief.Then through typical cases to explain the difficulties and current situation of judicial remedy for health damage caused by environmental pollution, analyze the existing problems and reasons, and then compare with the relevant theories and experiences of foreign countries.Some suggestions on how to improve and improve the judicial relief of health damage caused by environmental pollution in China are put forward from the aspects of legislation and system.The article mainly includes introduction, text, conclusion three parts, there are four chapters:The first part of the introduction: the author reveals that the world we live in is generally attacked by environmental pollution through many living examples, which has a great threat to people's physical and mental health, environmental health problems should not be underestimated;Secondly, the author points out that the essence of environmental infringement on health is the infringement of citizen's basic right to health, and the main research purpose of this paper is described at last.The second part contains four chapters: the first chapter "understanding and definition of basic concepts": the key words involved in the title of the article, such as "environmental pollution",The concept of "health damage" and "judicial remedy" is interpreted and limited in scope, and the importance of judicial relief is emphasized by comparing with other remedies.The second chapter is "the current situation and existing problems of judicial remedy for health damage caused by environmental pollution in our country": through several typical cases, it reflects the current situation of judicial relief of health damage caused by environmental pollution in China.This paper analyzes the main problems and the causes of the problems in the judicial relief in our country.The third chapter, "the investigation of the relevant theories and systems of the judicial remedy for the health damage caused by environmental pollution abroad and the reference to our country": the investigation and comparison of the relevant theories and systems of the judicial relief of the health damage caused by the main environmental pollution abroad.And analyze its reference to our country.The fourth chapter is "the suggestion of perfecting the judicial remedy of health damage caused by environmental pollution in China": from the aspects of legislation and system, the author puts forward some concrete measures to perfect the judicial remedy of health damage caused by environmental pollution in China.The third part: summarizes the innovation of the article, points out its shortcomings, and expects that the theory and system will be more perfect in the future.
