【摘要】：面對日益嚴(yán)峻的環(huán)境壓力,人們紛紛對傳統(tǒng)的經(jīng)濟(jì)增長方式和經(jīng)濟(jì)發(fā)展理論進(jìn)行反思,從單純的追求經(jīng)濟(jì)的增長擴(kuò)大到經(jīng)濟(jì)的循環(huán)發(fā)展,追求人與社會的和諧發(fā)展。20世紀(jì)90年代以來,許多發(fā)達(dá)國家都將發(fā)展循環(huán)經(jīng)濟(jì)、建立循環(huán)型社會作為實(shí)現(xiàn)保護(hù)環(huán)境和實(shí)現(xiàn)經(jīng)濟(jì)協(xié)調(diào)發(fā)展的一個重要途徑。黨和國家也意識到了這一點(diǎn),明確提出了發(fā)展循環(huán)經(jīng)濟(jì)是加快建設(shè)資源節(jié)約型和環(huán)境友好型社會的重要手段之一。生產(chǎn)者責(zé)任延伸制度是發(fā)展循環(huán)經(jīng)濟(jì)的一項(xiàng)重要保障措施,能起到保駕護(hù)航的作用,生產(chǎn)者責(zé)任延伸制度是將生產(chǎn)者的責(zé)任延伸到整個產(chǎn)品的生命周期,特別是強(qiáng)調(diào)產(chǎn)品設(shè)計(jì)和產(chǎn)品回收、循環(huán)利用等產(chǎn)品消耗之后的責(zé)任,并強(qiáng)調(diào)政府、銷售者和群眾也應(yīng)該承擔(dān)起自己應(yīng)有的責(zé)任。2008年8月29日通過,并于2009年1月1日施行的《循環(huán)經(jīng)濟(jì)促進(jìn)法》更加明確了生產(chǎn)者責(zé)任延伸制度。本文通過對循環(huán)經(jīng)濟(jì)促進(jìn)法的基本理論問題進(jìn)行研究,從循環(huán)經(jīng)濟(jì)的概念、特征、理論來源和責(zé)任主體等部分進(jìn)行闡述,并借鑒國外先進(jìn)的經(jīng)驗(yàn),側(cè)重結(jié)合我國于2009年1月1日施行的《循環(huán)經(jīng)濟(jì)促進(jìn)法》對生產(chǎn)者責(zé)任延伸制度的規(guī)定來對生產(chǎn)者責(zé)任研究制度進(jìn)行進(jìn)一步的研究,以期促進(jìn)生產(chǎn)者責(zé)任延伸制度的完善和更好的實(shí)施,促進(jìn)經(jīng)濟(jì)的循環(huán)發(fā)展,促進(jìn)人與社會的和諧發(fā)展。 本文共分為四章,具體如下： 第一章是循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的理論基本理論問題,第一節(jié)為循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的概念,第二節(jié)為循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的相關(guān)理論問題。筆者通過介紹不同國家、地區(qū)以及我國學(xué)者對生產(chǎn)者責(zé)任延伸制度的定義,進(jìn)一步梳理了筆者對循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的理解。同時,本章還對循環(huán)經(jīng)濟(jì)促進(jìn)法的生產(chǎn)者責(zé)任延伸制度其他相關(guān)基本理論問題進(jìn)行了介紹,通過生產(chǎn)者責(zé)任延伸制度的概念、特征、責(zé)任主體、價值取向和作用、理論基礎(chǔ)等進(jìn)行闡述,以期對循環(huán)經(jīng)濟(jì)促進(jìn)法的生產(chǎn)者責(zé)任延伸制度有更加深刻的理解,并為后面的論斷提供理論依據(jù)。 第二章是國外循環(huán)經(jīng)濟(jì)促進(jìn)法的生產(chǎn)者責(zé)任延伸制度以及啟示。本章主要介紹了瑞典、德國等歐盟國家、美國、日本等國家生產(chǎn)者責(zé)任延伸制度的立法和具體的實(shí)踐操作,并總結(jié)出對我國建立和完善循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的啟示。 第三章是我國循環(huán)經(jīng)濟(jì)促進(jìn)法的生產(chǎn)者責(zé)任延伸制度的相關(guān)規(guī)定及存在的問題分析。本章通過對我國循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的具體規(guī)定,并結(jié)合在實(shí)踐中存在的問題,提出了我國循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度存在的問題。 第四章是完善我國循環(huán)經(jīng)濟(jì)促進(jìn)法生產(chǎn)者責(zé)任延伸制度的基本構(gòu)想。這一部分,主要從明確相關(guān)責(zé)任主體的合理定位、激勵措施、信息責(zé)任、公眾參與以及其他相配套的措施等方面進(jìn)行構(gòu)想。

This article is divided into four chapters, which are as follows:
The first chapter is the basic theory of Circular Economy Promotion Law of extended producer responsibility system, the first section is the method of producer responsibility extension system to promote circular economy concept, the second section is the theoretical problems related to circular economy promotion law system of extended producer responsibility. The author through the introduction of different countries, regions and Chinese scholars on the extended producer responsibility system the definition of the author to further sort out the law to promote circular economy system of extended producer responsibility understanding. At the same time, this chapter also discusses the method of circular economy to promote the system of extended producer responsibility and other issues related to basic theory are introduced, through the system of extended producer responsibility concept, characteristics, main responsibility, role and value orientation, theoretical basis carries on the elaboration, in order to promote circular economy law system of extended producer responsibility to have a more profound understanding, and for the following The argument provides a theoretical basis.
The second chapter is the foreign circular economy promotion law of the extended producer responsibility system and enlightenment. This chapter mainly introduces Sweden, Germany and other EU countries, the United States, the system of legislation and practical operation of the extended producer responsibility in Japan and other countries, and summed up the establishment and improvement of our country's circular economy promotion law system of extended producer responsibility enlightenment.
The third chapter is the analysis of the relevant provisions of China's Circular Economy Promotion Law of the extended producer responsibility system and the existing problems. This chapter based on the specific provisions of China's Circular Economy Promotion Law of extended producer responsibility system, and combined with the problems in the practice, put forward China's Circular Economy Promotion law has extended producer responsibility system the problem.
The fourth chapter is the basic idea of improving the producer responsibility extension system of the circular economy promotion law in China. This part mainly from the clear positioning of the relevant responsible subjects, incentive measures, information responsibility, public participation and other supporting measures.
