【摘要】： 森林資源是陸地生態(tài)系統(tǒng)的主體,對于維護(hù)自然生態(tài)系統(tǒng)的平衡和改善生態(tài)環(huán)境、保障國土生態(tài)安全具有重要意義。此外,森林資源還承擔(dān)著林產(chǎn)品供給的重要任務(wù),是我國社會主義現(xiàn)代化建設(shè)不可缺少的重要生產(chǎn)資料。本文對我國目前森林資源法律管理的現(xiàn)狀進(jìn)行深入剖析,指出我國森林資源法律管理存在森林資源法律管理的基本原則缺失、森林資源物權(quán)管理和債權(quán)管理不完善、森林資源糾紛解決機(jī)制單一等問題。這些問題導(dǎo)致實踐中對森林資源進(jìn)行濫砍亂伐、過度開發(fā)利用以及毀林開墾、亂占林地的不良后果。因此,在借鑒美國、德國、瑞典以及俄羅斯等國森林資源法律管理成功經(jīng)驗的基礎(chǔ)上,運用科學(xué)的方法提出了適合我國國情的森林資源法律管理體系。 該體系包括確立森林資源法律管理基本原則、規(guī)范森林資源物權(quán)管理、完善森林資源債權(quán)管理以及健全森林資源糾紛解決機(jī)制四個方面。確立森林資源法律管理基本原則包括依法管理原則和統(tǒng)籌兼顧多方利益原則;規(guī)范森林資源物權(quán)管理包括公益林物權(quán)法律制度的完善以及商品林物權(quán)法律制度的健全;完善森林資源債權(quán)管理包括林權(quán)流轉(zhuǎn)主體資格的明確和流轉(zhuǎn)合同的標(biāo)準(zhǔn)化;健全森林資源糾紛解決機(jī)制包括調(diào)解制度、和解制度、仲裁制度、訴訟制度和各糾紛解決機(jī)制間協(xié)作機(jī)制。但是,鑒于森林資源法律管理的復(fù)雜性以及我國森林資源法律管理的現(xiàn)狀,要建立健全森林資源法律管理體制也不是一朝一夕的事情。對此,我們不能走極端的道路,而應(yīng)尊重我國的現(xiàn)實國情,以森林資源可持續(xù)發(fā)展思想為指導(dǎo),逐步發(fā)展和完善,實現(xiàn)森林資源的長期穩(wěn)定的發(fā)展。
[Abstract]:Forest resources are the main body of terrestrial ecosystem, which is of great significance for maintaining the balance of natural ecosystem, improving ecological environment and ensuring the ecological security of land. In addition, forest resources also undertake the important task of supplying forest products. It is an indispensable and important means of production in the construction of socialist modernization in China. The present situation of legal management of forest resources in China is deeply analyzed in this paper. It is pointed out that the basic principles of forest resource legal management are absent, and the management of real right and creditor's rights of forest resources is not perfect. Problems such as single dispute resolution mechanism of forest resources. These problems lead to the adverse consequences of deforestation, over-exploitation and utilization of forest resources in practice, and deforestation and reclamation, and the indiscriminate occupation of woodland. Therefore, in drawing lessons from the United States, Germany, the United States, Germany, the United States, Germany, the United States, Germany, the United States, Germany, On the basis of the successful experiences of Sweden and Russia in the legal management of forest resources, this paper puts forward a legal management system of forest resources suitable for the national conditions of our country by means of scientific methods. The system includes establishing the basic principles of legal management of forest resources and standardizing the management of real rights of forest resources. Perfecting the management of forest resources creditor's rights and perfecting the dispute resolution mechanism of forest resources, establishing the basic principles of forest resources legal management, including the principle of legal management and the principle of taking into account the interests of all sides; Standardizing the real right management of forest resources includes perfecting the legal system of real right of public welfare forest and the legal system of real right of commercial forest, perfecting the management of creditor's rights of forest resources, including the clear qualification of the subject of forest right transfer and the standardization of circulation contract. Improve forest resources dispute resolution mechanisms including mediation system, conciliation system, arbitration system, litigation system and coordination mechanism among dispute resolution mechanisms. In view of the complexity of the legal management of forest resources and the present situation of the legal management of forest resources in China, it is not an overnight task to establish and improve the legal management system of forest resources. In order to realize the long-term and stable development of forest resources, we should respect the actual situation of our country, take the thought of sustainable development of forest resources as the guide, develop and perfect gradually.
