【摘要】：市場(chǎng)準(zhǔn)入制度是政府通過(guò)行政規(guī)制對(duì)能源市場(chǎng)主體進(jìn)入相關(guān)產(chǎn)品市場(chǎng)市場(chǎng)進(jìn)行干預(yù),以促進(jìn)能源市場(chǎng)的健康發(fā)展。目前我國(guó)能源資源利用效率低、環(huán)境污染嚴(yán)重,能源領(lǐng)域缺少基本法,已出臺(tái)的法律之間配合性不足,并且《能源法》的起草工作得到高度的重視。能源市場(chǎng)準(zhǔn)入制度作為解決上述問(wèn)題重要的一環(huán),其具體制定方法在立法中也未能達(dá)成統(tǒng)一。在此背景下,本文介紹了市場(chǎng)準(zhǔn)入制度的法理基礎(chǔ),分析了市場(chǎng)準(zhǔn)入制度在民商法、行政法以及經(jīng)濟(jì)法三個(gè)部門法中的體現(xiàn):民商法中的市場(chǎng)準(zhǔn)入制度主要是針對(duì)市場(chǎng)中主體的資質(zhì),保證市場(chǎng)主體的平等地位;行政法中的市場(chǎng)準(zhǔn)入制度則是為了規(guī)范政府,限制行政機(jī)關(guān)的權(quán)力;經(jīng)濟(jì)法中的市場(chǎng)準(zhǔn)入制度是以打破壟斷為目的,并依據(jù)不同的能源類型為此制度的實(shí)施提供具體細(xì)則。在設(shè)計(jì)具體的能源市場(chǎng)準(zhǔn)入制度時(shí),還要遵循四個(gè)原則:保障能源安全原則、節(jié)能和高效原則、保障能源革命原則、以能源市場(chǎng)化為主,并與政府監(jiān)管有機(jī)結(jié)合原則。在上述基礎(chǔ)理論的支撐下,本文將能源市場(chǎng)分為核能市場(chǎng),電力市場(chǎng),煤炭、石油、天然氣市場(chǎng),清潔能源市場(chǎng)和能源服務(wù)市場(chǎng)五個(gè)部分,分別分析了不同能源領(lǐng)域的側(cè)重點(diǎn),并結(jié)合新發(fā)布的《市場(chǎng)準(zhǔn)入負(fù)面清單草案(試點(diǎn)版)》,介紹"負(fù)面清單"制度在能源市場(chǎng)準(zhǔn)入中的地位及其使用方法,將不同的能源領(lǐng)域與"負(fù)面清單"制度、許可制、核準(zhǔn)制、注冊(cè)制、審批制和備案制相匹配,設(shè)計(jì)出了我國(guó)能源市場(chǎng)準(zhǔn)入制度的框架,并提出相應(yīng)的立法建議。優(yōu)化我國(guó)能源結(jié)構(gòu),轉(zhuǎn)變政府的職能,更好的促進(jìn)我國(guó)能源市場(chǎng)的發(fā)展。
[Abstract]:The system of market access is that the government interferes with the main body of energy market to enter the market of related products through administrative regulation in order to promote the healthy development of energy market. At present, the utilization efficiency of energy resources in our country is low, and the environment pollution is serious. The lack of a basic law in the field of energy, the insufficient coordination between the laws that have been put in place, and the high priority given to the drafting of the Energy Act. The energy market access system is an important part of the solution to the above problems, In this context, this paper introduces the legal basis of the market access system, analyzes the market access system in the civil and commercial law, The market access system in the civil and commercial law is mainly aimed at the qualification of the main body in the market and ensures the equal status of the market subject, and the market access system in the administrative law is to standardize the government. Restrictions on the powers of administrative organs; market access systems in economic law are designed to break monopolies and provide specific rules for the implementation of the system based on different energy types. In designing specific energy market access systems, There are also four principles to be followed: the principle of ensuring energy security, the principle of energy conservation and efficiency, the principle of safeguarding the energy revolution, the principle of energy marketization, and the principle of organic integration with government supervision. This paper divides the energy market into five parts: nuclear energy market, electricity market, coal market, oil market, natural gas market, clean energy market and energy service market. In the light of the newly released draft negative list for Market access (pilot version), this paper introduces the status of the "negative list" system in energy market access and its use methods, and combines different energy fields with the "negative list" system, licensing system, and approval system. The registration system, the examination and approval system and the record keeping system are matched to design the framework of the energy market access system of our country, and put forward the corresponding legislative suggestion, optimize the energy structure of our country, change the function of the government, promote the development of the energy market of our country better.
