【摘要】：本論文的目的在于為中國應對氣候變化立法提出完善的方案。本文首先介紹了氣候變化的基本概念、特點以及對人類造成的影響,得出應當對氣候變化進行法律規(guī)制的結論。其次,分析了應對氣候變化的可持續(xù)發(fā)展思想、法哲學與法經(jīng)濟學基礎。再次,以減緩性立法與適應性立法為脈絡列舉了歐盟、英國、日本、美國與我國的立法成果,提煉出了以上發(fā)達國家與我國法律體系的立法脈絡；通過分析發(fā)達國家的先進經(jīng)驗,結合我國目前的立法不足,最終提出了我國完善應對氣候變化立法體系堅持的原則和具體方案,為我國這一法律體系的完善提供一點借鑒。本文采用了比較研究的方法,創(chuàng)新之處在于把立法的思路與應對氣候變化的途徑結合,提出了應對氣候變化立法從宏觀上分為減緩性立法與適應性立法兩部分,減緩性立法又分為提高能效與支持新型能源發(fā)展兩部分,再對提高能效與支持新型能源發(fā)展兩部分中的各種制度進行針對性立法,適應性立法則按照收氣候變化影響的領域劃分為農(nóng)業(yè)、水資源、海洋、衛(wèi)生健康、氣象領域五大領域,同時建立稅收與市場激勵立法對減緩性與適應性行動給予資金的支持。
[Abstract]:The purpose of this paper is to put forward a perfect solution for climate change legislation Chinese. This paper first introduces the basic concepts of climate change, characteristics and impact on human caused, it shall be the legal regulation of climate change results. Secondly, the analysis of climate change sustainable development thought, philosophy of law and economics of law. Again, to slow down the legislation and legislative context lists adaptability of EU, UK, Japan, the United States and China's legislative achievements, summarizes the legislative context more than in developed countries and our country's legal system; through the analysis of the advanced experience of developed countries, combined with China's current lack of legislation, finally put forward to our country perfect the legislation system of the principle of addressing climate change and the specific plan, provide a reference for perfecting the legal system. This paper uses the method of comparative research, innovation The new lies in the ways of combining the ideas and climate change legislation, proposed climate change legislation is divided into slow legislation and adaptability of the two part of the macro legislation, legislation and mitigation in order to improve the efficiency and support of new energy development in the two part, to improve energy efficiency and support of new energy development system of two parts in the specific legislation, legislation in accordance with the adaptability received the impact of climate change into agricultural fields, water resources, marine, health, meteorology in five major areas, at the same time, the establishment of tax legislation and market incentives to slow and adaptive actions provide financial support.
