【摘要】：生態(tài)環(huán)境是人類及其他一切生命存在和發(fā)展的基本條件,是經(jīng)濟(jì)、社會(huì)發(fā)展的基礎(chǔ)。在生態(tài)文明建設(shè)背景下考察中國(guó)生態(tài)功能區(qū)保護(hù)的理論與實(shí)踐,具有特別重要的意義,不僅影響著社會(huì)經(jīng)濟(jì)的發(fā)展,也影響著生態(tài)文明建設(shè)的進(jìn)程。撫仙湖生態(tài)功能區(qū)生態(tài)環(huán)境十分脆弱,對(duì)國(guó)家生態(tài)、經(jīng)濟(jì)安全及全面、協(xié)調(diào)、可持續(xù)發(fā)展有著重要影響。近年來(lái),隨著撫仙湖生態(tài)功能區(qū)的大肆開發(fā)建設(shè),生態(tài)破壞活動(dòng)劇烈,生態(tài)保護(hù)和經(jīng)濟(jì)發(fā)展之間的矛盾不斷深化。通過出臺(tái)新政策、完善法律法規(guī)來(lái)保護(hù)撫仙湖生態(tài)功能區(qū)刻不容緩。本文旨在進(jìn)一步完善撫仙湖生態(tài)功能區(qū)的法律法規(guī),提出撫仙湖生態(tài)功能區(qū)保護(hù)應(yīng)遵循的法律原則、適用的法律制度和承擔(dān)的法律責(zé)任。通過強(qiáng)有力的法律手段來(lái)實(shí)現(xiàn)撫仙湖生態(tài)功能區(qū)的有效保護(hù),推進(jìn)區(qū)域全面、協(xié)調(diào)、可持續(xù)發(fā)展。首先,本文參考《全國(guó)生態(tài)功能區(qū)劃》、《全國(guó)主體功能區(qū)規(guī)劃》等多部政府性文件,借鑒國(guó)內(nèi)多位學(xué)者對(duì)生態(tài)功能區(qū)的認(rèn)識(shí),概括出生態(tài)功能區(qū)的概念及其特征,明確撫仙湖生態(tài)功能區(qū)為本文研究范圍,對(duì)撫仙湖生態(tài)功能區(qū)的生態(tài)環(huán)境及其生態(tài)功能進(jìn)行分析。其次,梳理?yè)嵯珊鷳B(tài)功能區(qū)立法體系、立法理念、立法原則和主要制度。再次,進(jìn)行撫仙湖生態(tài)功能區(qū)地方立法實(shí)踐分析,通過評(píng)析《云南省撫仙湖保護(hù)條例》、《玉溪市撫仙湖保護(hù)治理管理辦法》,提出撫仙湖生態(tài)功能區(qū)法律保護(hù)存在的問題。最后,從保護(hù)范圍、法律原則、管理體制、法律制度、法律責(zé)任五個(gè)方面提出撫仙湖生態(tài)功能區(qū)的法律完善建議。
[Abstract]:The ecological environment is the basic condition that humans and all other life is the existence and development of the economy, the foundation of social development. Analysis of the theory and practice of the protection of China ecological function areas in the context of the ecological civilization construction, is of great significance, not only affects the development of social economy, but also affect the ecological civilization construction of ecological processes. The environment of Fuxian Lake ecological function area is very fragile, the national ecological, economic security and comprehensive, coordinated, sustainable development has an important influence. In recent years, along with the Fuxian Lake ecological function areas to development and construction, ecological destruction is intense, the contradiction between ecological protection and economic development deepened. Through the introduction of the new policy, perfect laws and regulations to protect Fuxian Lake ecological function area is urgent. This paper aims to further improve the laws and regulations of Fuxian Lake ecological function area, put forward the Fuxian Lake ecological function zones. Support of legal principles, applicable legal system and legal liabilities. Through legal means strong to achieve effective protection of Fuxian Lake ecological function region, promote regional comprehensive coordination, sustainable development. Secondly, the legislative system, combing the Fuxian Lake ecological function area legislative idea. The legislative principles and main system.
