【摘要】："線性生態(tài)文明觀"面臨著難以自圓其說(shuō)的邏輯漏洞,"系統(tǒng)生態(tài)文明觀"應(yīng)當(dāng)成為檢視和構(gòu)建《核安全法》基本原則的指導(dǎo)性理念�！逗税踩�(草案)》中的"確保安全方針"與"安全第一原則"構(gòu)成語(yǔ)義重復(fù),同時(shí)放入基本原則條款無(wú)異于焚琴煮鶴;"縱深防御"并不具有原則的特質(zhì),更適宜作為一項(xiàng)制度進(jìn)行規(guī)定;"嚴(yán)格管理"和"全面保障"宜合并為"全過(guò)程嚴(yán)格監(jiān)管原則"。此外,從解釋論的角度看,"責(zé)任明確原則"應(yīng)當(dāng)偏重理解為行政權(quán)力的"決策擔(dān)責(zé)",方能從源頭規(guī)避和治理核安全風(fēng)險(xiǎn);從建構(gòu)論的角度看,《核安全法》中應(yīng)當(dāng)增加"信息公開原則"和"公眾參與原則",從而實(shí)現(xiàn)"監(jiān)管核安全監(jiān)管者"之目的。
[Abstract]:The concept of "linear ecological civilization" is faced with a logical loophole which is difficult to justify itself, and "system ecological civilization" should be the guiding idea to examine and construct the basic principles of the Nuclear Safety Law. The security policy and the "safety first principle" constitute a semantic repetition. At the same time, the inclusion of basic principle clauses is tantamount to incinerating the harp and boiling cranes; "deep defense" does not have the characteristics of principle and is more suitable for regulation as a system; "strict management" and "comprehensive protection" should be merged into the "principle of strict supervision throughout the whole process." in addition, From the angle of explanation theory, the principle of "clear responsibility" should be interpreted as "responsibility for decision-making" of administrative power so as to avoid and control the risk of nuclear safety from the source. From the point of view of constructivism, the "principle of information disclosure" and "principle of public participation" should be added to the Nuclear Safety Law, so as to achieve the purpose of "supervision of nuclear safety regulators".
