【摘要】：我國是世界上吸引外資最多的國家,外商直接投資在我國國民經(jīng)濟(jì)中居有重要的地位,其對我國經(jīng)濟(jì)發(fā)展的影響不言而喻。然而,外商直接投資在給我國帶來經(jīng)濟(jì)發(fā)展和技術(shù)進(jìn)步的同時,也帶來了污染轉(zhuǎn)移等環(huán)境問題,破壞了我國的生態(tài)環(huán)境,嚴(yán)重影響我國的可持續(xù)發(fā)展。 造成外商直接投資中污染轉(zhuǎn)移問題的原因可以從很多方面探究,從法律層面上看,是因為現(xiàn)行法對這一問題的規(guī)制不足。規(guī)制外商直接投資中污染轉(zhuǎn)移的法律涉及國際法和國內(nèi)法兩個方面,目前在國際法中雖有一些涉及外商直接投資中的污染轉(zhuǎn)移的規(guī)定,但這些規(guī)定缺少嚴(yán)格的執(zhí)行標(biāo)準(zhǔn)和有力的制裁手段,缺乏可執(zhí)行性。要解決我國外商直接投資中的污染轉(zhuǎn)移問題,主要還是依靠國內(nèi)法律的控制和監(jiān)督。我國現(xiàn)行國內(nèi)法對外商直接投資中污染轉(zhuǎn)移問題的規(guī)制總體上可以分成三個方面：第一,通過外資準(zhǔn)入對外商直接投資中的污染轉(zhuǎn)移進(jìn)行規(guī)制；第二,通過環(huán)境管理制度對外商直接投資中的污染轉(zhuǎn)移進(jìn)行規(guī)制；第三,通過追究環(huán)境責(zé)任對外商直接投資中的污染轉(zhuǎn)移進(jìn)行規(guī)制。但這三個方面都存在一定的不足,加之我國在環(huán)保方面執(zhí)法不力、公眾參與制度不完善,致使我國對外商直接投資中的污染轉(zhuǎn)移規(guī)制不足。 因此,我國應(yīng)在科學(xué)發(fā)展觀的指導(dǎo)下,用可持續(xù)發(fā)展的理念來指引立法活動,完善相關(guān)制度,提高環(huán)保執(zhí)法的水平,發(fā)展公眾參與制度,從而對外商直接投資中污染轉(zhuǎn)移進(jìn)行有效的法律規(guī)制。
[Abstract]:China is the country that attracts the most foreign capital in the world. Foreign direct investment (FDI) plays an important role in the national economy of our country, and its influence on the economic development of our country is self-evident. Foreign direct investment (FDI) not only brings economic development and technological progress to our country, but also brings environmental problems such as pollution transfer, which destroys the ecological environment of our country and seriously affects the sustainable development of our country. The causes of the problem of pollution transfer in foreign direct investment can be explored from many aspects and viewed from the legal level. This is because the current law does not adequately regulate this issue. The laws regulating the transfer of pollution in foreign direct investment involve both international law and domestic law. Although there are some provisions in international law concerning the transfer of pollution in foreign direct investment, However, these provisions lack strict standards of enforcement, effective sanctions, and lack of enforceability. It is necessary to solve the problem of pollution transfer in China's foreign direct investment. The regulation of pollution transfer in foreign direct investment in China can be divided into three aspects: first, Regulating the pollution transfer in foreign direct investment through the entry of foreign capital; second, regulating the pollution transfer in foreign direct investment through the environmental management system; third, The pollution transfer in FDI is regulated by investigating environmental responsibility. However, there are some deficiencies in these three aspects, in addition, the law enforcement in environmental protection is weak, and the system of public participation is not perfect. As a result, China's foreign direct investment in the regulation of pollution transfer is inadequate. Therefore, under the guidance of the scientific concept of development, our country should use the concept of sustainable development to guide legislative activities, improve relevant systems, improve the level of environmental law enforcement, and develop the system of public participation. In order to foreign direct investment in the transfer of pollution for effective legal regulation.
