【摘要】： 環(huán)境知情權(quán)是公眾對本國乃至世界的環(huán)境狀況、國家的環(huán)境管理狀況以及自身的環(huán)境狀況等有關(guān)信息獲得的權(quán)利,該權(quán)利是在環(huán)境權(quán)的基礎(chǔ)上發(fā)展起來的。環(huán)境民主是其產(chǎn)生的政治基礎(chǔ),環(huán)境侵權(quán)預防和救濟是其產(chǎn)生的社會基礎(chǔ)。它的主體包括自然人、社會團體組織;客體是環(huán)境信息,內(nèi)容包括知曉的權(quán)利,申請的權(quán)利獲得幫助和救濟的權(quán)利。環(huán)境知情權(quán)具有控權(quán)的作用和多重法律價值,即效率價值、自由價值、正義和秩序價值。它的產(chǎn)生受到各國的關(guān)注。就我國而言,環(huán)境知情權(quán)越來越得到關(guān)注,但是由于起步較晚,各方面的法律制度還不夠完善,比如在環(huán)境信息公開、公眾獲得環(huán)境信息的權(quán)利、保障環(huán)境信息救濟等方面還存在很多缺陷。 針對當前我國環(huán)境知情權(quán)法律保護制度的不完善,本文從我國環(huán)境知情權(quán)法律保護的現(xiàn)狀及存在的問題出發(fā),以我國現(xiàn)有的相關(guān)法規(guī)關(guān)于對環(huán)境知情權(quán)法律保護所作的規(guī)定為研究的基礎(chǔ)和出發(fā)點,借鑒世界部分發(fā)達國家環(huán)境知情權(quán)法律保護制度的經(jīng)驗與教訓,深層次地研究了我國環(huán)境知情權(quán)法律保護制度的改革與發(fā)展,在立法層面上對它的未來發(fā)展趨勢做出了展望。本人認為我國環(huán)境知情權(quán)法律保護制度應從以下五個方面加以完善,即完善政府環(huán)境信息公開制度、完善環(huán)境信息獲取制度、完善企業(yè)環(huán)境信息公開制度、完善環(huán)境信息公開與公眾參與相結(jié)合的制度、以及完善與環(huán)境知情權(quán)相關(guān)的行政法律制度。本文就如何完善這些制度提出了一些具體的設想。
[Abstract]:The right to know about the environment is the right of the public to obtain the relevant information, such as the state of the environment in our country and the world, the state of environmental management of the country and the state of our own environment. This right is developed on the basis of environmental right. Environmental democracy is the political basis of its emergence, and environmental tort prevention and relief is its social foundation. Its main body includes natural persons and social organizations. The object is environmental information, including the right to know, the right to apply for help and the right to relief. The right to know the environment has the role of control and multiple legal values, namely, the value of efficiency, the value of freedom. The value of justice and order. It has attracted the attention of all countries. As far as our country is concerned, the right to know about the environment is getting more and more attention, but due to the late start, the legal system in all aspects is not perfect enough. For example, there are still many defects in environmental information disclosure, public access to environmental information, protection of environmental information relief and so on. In view of the imperfect legal protection system of environmental right to know in our country, this paper starts from the current situation and existing problems of the legal protection of environmental right to know in our country. Based on the existing laws and regulations on the legal protection of the right to know environmental protection as the basis and starting point of the study, draw lessons from some developed countries in the world of environmental right to know legal protection system experience and lessons. This paper deeply studies the reform and development of the legal protection system of the right to know of the environment in our country. In the legislative level to its future development trend has made the prospect. I think our country environmental right to know the legal protection system should be perfected from the following five aspects, namely consummates the government environmental information disclosure system. Perfect the system of obtaining environmental information, perfect the open system of enterprise environmental information, perfect the system of combining environmental information openness with public participation. As well as perfecting the administrative legal system related to the right to know about the environment, this paper puts forward some concrete ideas on how to perfect these systems.
