【摘要】：英美法系著名學(xué)者塞繆爾.威利斯頓對美國法律學(xué)術(shù)及法律教育的影響是深遠(yuǎn)的。威利斯頓起草了多部法典,為三十幾個州所用。他是第一次《合同法重述》的起草負(fù)責(zé)人及報告人,撰寫了《合同法》,被視為年輕法律人士的書面向?qū)А１疚耐ㄟ^對塞繆爾.威利斯頓學(xué)術(shù)理論體系的借鑒,通過對其法律理論實(shí)用性價值的剖析,以及對其學(xué)術(shù)理論所產(chǎn)生的不同看法的考量,來闡明其理論實(shí)用性價值及規(guī)范性引導(dǎo)對法律教育的重要作用。
[Abstract]:Samuel, a famous scholar in Anglo-American law system. Williston's influence on the American legal academic and legal education is profound. Williston drafted several codes for use in more than thirty states. He was the draftsman and presenter of the first restatement of contract Law, and was regarded as a written guide for young lawyers. This paper deals with Samuel. By analyzing the practical value of Williston's academic theory system, and considering the different views produced by his academic theory, To clarify its theoretical practical value and normative guidance of the important role of legal education.
