【摘要】：經(jīng)營者場所安全保障義務(wù)符合危險(xiǎn)控制理論、實(shí)質(zhì)平等理念、信賴關(guān)系原理、收益與風(fēng)險(xiǎn)的平衡、社會(huì)總成本節(jié)約等法理依據(jù)。場所安全保障義務(wù)包括對(duì)危險(xiǎn)源可能存在的警告、對(duì)危險(xiǎn)源的調(diào)查與通知和對(duì)危險(xiǎn)源的控制義務(wù)。其義務(wù)主體應(yīng)適當(dāng)擴(kuò)大,并確立場所安全保障義務(wù)在合同法中的地位、明確違反場所安全保障義務(wù)的歸責(zé)原則為過錯(cuò)責(zé)任原則并實(shí)行過錯(cuò)推定,增加第三人責(zé)任與補(bǔ)充責(zé)任的規(guī)定。
[Abstract]:The duty of safety and security of operator's place accords with the theory of risk control, the concept of substantive equality, the principle of trust relationship, the balance between profit and risk, and the saving of total social cost. The duty of site safety and security includes the warning of the possible existence of the hazard source, the investigation and notification of the hazard source, and the obligation to control the hazard source. The subject of the duty should be expanded appropriately, and the position of the duty of place safety and security in the contract law should be established, and the principle of imputation of liability for breach of the obligation of safety and security of the place should be established as the principle of fault liability and the presumption of fault. Add the third party liability and supplementary liability provisions.
