我國(guó)勞務(wù)派遣面臨的困境及對(duì)策研究

【摘要】:勞務(wù)派遣作為一種特殊的用工形式,發(fā)端于歐美等市場(chǎng)經(jīng)濟(jì)發(fā)達(dá)的國(guó)家和地區(qū),在我國(guó)形成和發(fā)展的時(shí)間跨度并不長(zhǎng)。勞務(wù)派遣作為一種非主流的用工形式,一直是我國(guó)勞動(dòng)合同法立法中的焦點(diǎn)問(wèn)題之一。隨著我國(guó)勞動(dòng)力資源配置的市場(chǎng)化,尤其是2008年《勞動(dòng)合同法》實(shí)施以后,勞務(wù)派遣卻出現(xiàn)了超常發(fā)展的趨勢(shì),大有替代標(biāo)準(zhǔn)勞動(dòng)關(guān)系之勢(shì)。2012年12月28日,十一屆全國(guó)人大常委會(huì)第三十次會(huì)議審議通過(guò)了《關(guān)于修改中華人民共和國(guó)勞動(dòng)合同法的決定》,并于2013年7月1日起實(shí)施,本次修法的主要內(nèi)容圍繞勞務(wù)派遣展開(kāi),再次將勞務(wù)派遣推向了風(fēng)口浪尖。本次修法意義重大,但是能否從根本上解決我國(guó)勞務(wù)派遣超常發(fā)展的問(wèn)題,勞務(wù)派遣將何去何從?仍值得我們深思和研究。傳統(tǒng)的勞動(dòng)關(guān)系是一對(duì)一的用工模式,而勞務(wù)派遣卻打破了這一傳統(tǒng),由于勞務(wù)派遣的本質(zhì)特征是“雇傭”和“使用”相分離,它雖提高了勞動(dòng)者就業(yè)的靈活性,但由于派遣機(jī)構(gòu)作為雇主并不是勞動(dòng)者勞動(dòng)給付的對(duì)象,而要派機(jī)構(gòu)作為實(shí)際用工單位,卻并不是勞動(dòng)報(bào)酬及相關(guān)保險(xiǎn)等費(fèi)用的直接支付者,所以在這一過(guò)程中勞務(wù)派遣三方主體之間的關(guān)系變得更加的復(fù)雜,很容易對(duì)勞動(dòng)者的合法權(quán)益造成損害。如果任由勞務(wù)派遣蓬勃發(fā)展下去,將不利于我國(guó)勞動(dòng)力市場(chǎng)的健康發(fā)展和社會(huì)經(jīng)濟(jì)秩序的穩(wěn)定。 面對(duì)我國(guó)勞務(wù)派遣的超常發(fā)展,其面臨的困境究竟何在,它將會(huì)是我國(guó)經(jīng)濟(jì)健康發(fā)展的一顆毒瘤,抑或是一劑良藥?本文首先對(duì)勞務(wù)派遣這一社會(huì)現(xiàn)象進(jìn)行理論上的解構(gòu),分析勞務(wù)派遣的概念、特征及各方主體間的法律關(guān)系,同時(shí)明確勞務(wù)派遣同類(lèi)似用工形態(tài)之間的界別,以此為我國(guó)勞務(wù)派遣出路的探討做理論上的鋪墊;其次,分別從靜態(tài)和動(dòng)態(tài)的角度,探討我國(guó)勞務(wù)派遣在制度層面和實(shí)際運(yùn)行當(dāng)中面臨的困境,以期對(duì)癥下藥;最后結(jié)合理論和實(shí)踐,從多維的視角對(duì)勞務(wù)派遣用工制度的規(guī)范、公法的管制、以及社會(huì)保障機(jī)制的健全進(jìn)行論述,為引導(dǎo)我國(guó)勞務(wù)派遣走向正軌提供一些參考及建議。
[Abstract]:As a special form of employment, labor dispatch originated in the developed countries and regions of market economy, such as Europe and America, and the time span of its formation and development in China is not long. As a non-mainstream form of employment, labor dispatch has always been one of the focal issues in the legislation of labor contract law in China. With the marketization of labor resource allocation in our country, especially after the implementation of the Labor contract Law in 2008, the labor dispatch has shown a trend of extraordinary development and has a tendency to replace the standard labor relations. The 30th meeting of the standing Committee of the Eleventh National people's Congress deliberated and adopted the decision on amending the Labor contract Law of the people's Republic of China, which came into effect on July 1, 2013. Once again, the dispatch of labor services to the cusp. The revision of the law is of great significance, but can we fundamentally solve the problem of the extraordinary development of labor dispatch in our country, and where will the labor dispatch go? It is still worth our deep thinking and study. The traditional labor relationship is a one-to-one mode of employment, but labor dispatch breaks this tradition. Because the essential characteristic of labor dispatch is the separation of "employment" and "use", it enhances the flexibility of employment. However, as an employer, the sending organization is not the object of labor payment to the laborer, but the sending organization, as the actual employer, is not the direct payer of labor compensation and related insurance, etc. Therefore, in this process, the relationship between the three parties of labor dispatch becomes more complex, it is easy to damage the legitimate rights and interests of workers. If labor dispatch is allowed to flourish, it will be unfavorable to the healthy development of labor market and the stability of social economic order. In the face of the extraordinary development of labor dispatch in our country, what is the dilemma it faces, it will be a cancer of the healthy development of our economy, or will it be a good medicine? This paper firstly deconstructs the social phenomenon of labor dispatch in theory, analyzes the concept, characteristics and legal relationship between labor dispatch and other parties, and at the same time clarifies the sector between labor dispatch and similar employment forms. Secondly, from the static and dynamic point of view, this paper discusses the difficulties in the system level and the actual operation of labor dispatch in our country, with a view to finding a remedy to the case. Finally, combined with theory and practice, this paper discusses the standardization of labor dispatch system, the regulation of public law and the perfection of social security mechanism from a multi-dimensional perspective, which provides some references and suggestions for guiding China's labor dispatch on the right track.
