勞務(wù)關(guān)系人身侵權(quán)損害賠償案件法律問題研究

【摘要】:為了解決使用人侵權(quán)責(zé)任問題,《中華人民共和國(guó)侵權(quán)責(zé)任法》第34條和第35條分別就用人單位與工作人員之間的使用關(guān)系、個(gè)人之間的使用關(guān)系所產(chǎn)生的侵權(quán)責(zé)任問題進(jìn)行了規(guī)定。對(duì)于用人單位與員工之間的使用關(guān)系,《勞動(dòng)法》、《勞動(dòng)合同法》、《勞動(dòng)爭(zhēng)議調(diào)解仲裁法》等相關(guān)的法律從實(shí)體及程序上進(jìn)行了規(guī)定,再加上大量的行政法規(guī)、地方性法規(guī)及部門規(guī)章,相對(duì)而言,相關(guān)法律關(guān)系的認(rèn)定、賠償責(zé)任的確定、爭(zhēng)議解決的程序及方法都比較健全。而對(duì)于個(gè)人之間使用關(guān)系的相關(guān)法律問題,則相對(duì)規(guī)定較少。關(guān)于如何適用侵權(quán)責(zé)任法的有關(guān)規(guī)定來認(rèn)定個(gè)人之間勞務(wù)關(guān)系,如何認(rèn)定個(gè)人之間勞務(wù)關(guān)系人身?yè)p害賠償案件中的過錯(cuò)以及如何區(qū)分過錯(cuò)程度等問題,直接關(guān)系到個(gè)人之間勞務(wù)關(guān)系中人身?yè)p害賠償?shù)那謾?quán)責(zé)任的承擔(dān),但對(duì)此相關(guān)研究還不多,且由于之前法律規(guī)定較少,故實(shí)際判例的結(jié)論也存在諸多不一致之處。為此,本文就個(gè)人之間勞務(wù)關(guān)系人身?yè)p害賠償案件中有關(guān)法律關(guān)系認(rèn)定、過錯(cuò)劃分、侵權(quán)損害賠償?shù)确矫?通過對(duì)實(shí)際案例的分析,結(jié)合國(guó)內(nèi)外有關(guān)國(guó)家的法律規(guī)定、實(shí)際判例,對(duì)于如何適用侵權(quán)責(zé)任法第35條進(jìn)行分析和研究,并就有關(guān)問題發(fā)表自己的觀點(diǎn)。 本文首先通過分析國(guó)內(nèi)外相關(guān)法律法規(guī)的規(guī)定,結(jié)合實(shí)際判例,對(duì)勞務(wù)關(guān)系與勞動(dòng)關(guān)系、雇傭關(guān)系進(jìn)行比較,歸納總結(jié)勞務(wù)關(guān)系的定義、特征及認(rèn)定條件,從而通過分析主體條件來解釋侵權(quán)責(zé)任法第35條規(guī)定的“個(gè)人之間勞務(wù)關(guān)系”的含義;其次,本文對(duì)勞務(wù)關(guān)系人身?yè)p害賠償案件的幾種事實(shí)進(jìn)行分析,以區(qū)別對(duì)外造成的第三人損害及內(nèi)部造成的勞務(wù)提供方或者勞務(wù)使用方的損害;第三,本文對(duì)勞務(wù)關(guān)系人身?yè)p害賠償案件的侵權(quán)性質(zhì)進(jìn)行分析,包括侵權(quán)行為、損害后果、因果關(guān)系以及過錯(cuò)認(rèn)定,并結(jié)合過錯(cuò)的定義、程度、認(rèn)定條件及有關(guān)法律法規(guī)進(jìn)行解釋,提出降低勞務(wù)關(guān)系人身?yè)p害賠償責(zé)任承擔(dān)者風(fēng)險(xiǎn)的處理對(duì)策;最后,通過上述各項(xiàng)分析,本文對(duì)在勞務(wù)關(guān)系人身?yè)p害賠償案件中如何適用侵權(quán)責(zé)任法第35條進(jìn)行歸納總結(jié)。
[Abstract]:In order to solve the problem of tort liability of users, articles 34 and 35 of the Tort liability Law of the people's Republic of China respectively deal with the use relationship between the employer and the staff. The issue of tort liability arising from the use of relationships between individuals is regulated. With regard to the use relationship between employers and employees, the relevant laws, such as the Labor Law, the Labor contract Law, the Labor dispute Mediation and Arbitration Law, and so on, have been stipulated in terms of entity and procedure, plus a large number of administrative laws and regulations. Local regulations and departmental regulations, relatively speaking, the identification of relevant legal relations, the determination of liability, dispute settlement procedures and methods are relatively sound. However, there are relatively few legal issues related to the use of relationships between individuals. How to apply the relevant provisions of tort liability law to determine the labor relations between individuals, how to determine the personal injury compensation cases between individuals, and how to distinguish the degree of fault, etc. It is directly related to the tort liability of personal injury compensation in the labor relations between individuals, but there are not many related researches on it, and the conclusion of the actual case law is not consistent because of the lack of legal provisions before. Therefore, through the analysis of the actual cases, this paper analyzes the related legal relationship, fault division, tort damages and so on in the personal injury compensation cases of the labor relations between individuals, combining with the laws and regulations of the relevant countries at home and abroad. In practical cases, the article 35 of tort liability law is analyzed and studied, and its views on relevant issues are presented. This article first through the analysis domestic and foreign related laws and regulations stipulation, unifies the actual precedent, carries on the comparison to the labor relations and the labor relations, the employment relations, summarizes the definition, the characteristic and the confirmation condition of the labor relations. The meaning of "personal labor relations" stipulated in Article 35 of the Tort liability Law is explained by analyzing the subjective conditions. Secondly, this paper analyzes several facts of personal injury compensation cases of labor relations. In order to distinguish the damage caused by the third party and the damage caused by the labor service provider or the labor service user; third, this article analyzes the tort nature of the personal injury compensation case of labor relations, including the tort, the damage consequences, Causality and fault identification, combined with the definition of fault, degree, conditions of identification and related laws and regulations to explain, proposed to reduce the risk of labor relations liability for personal injury liability to deal with the measures; finally, Through the above analysis, this paper summarizes how to apply Article 35 of Tort liability Law in personal injury compensation cases of labor relations.
