【摘要】：為第三人利益的合同在兩大法系國(guó)家已居于十分重要的地位。我國(guó)的合同法對(duì)為第三人利益的合同的規(guī)定存在著漏洞,應(yīng)學(xué)習(xí)其他國(guó)家相關(guān)規(guī)定的長(zhǎng)處,完善對(duì)為第三人利益的合同的規(guī)定。一方面應(yīng)該在合同法內(nèi)直接明確規(guī)定第三人的直接請(qǐng)求給付的權(quán)利,另一方面也應(yīng)該對(duì)為第三人利益合同的相關(guān)制度進(jìn)行完善。
[Abstract]:The contract for the benefit of the third party has occupied a very important position in the two legal system countries. The contract law of our country has the loophole to the contract for the benefit of the third party. We should study the advantages of the relevant provisions of other countries and perfect the stipulation of the contract for the benefit of the third party. On the one hand, the right of the third party's direct request for payment should be stipulated directly in the contract law, on the other hand, the relevant system of the contract for the third party's interests should be perfected.
