【摘要】：保險(xiǎn)合同的解除是保險(xiǎn)合同的當(dāng)事人行使合同解除權(quán)而使合同的效力歸于消滅的一種法律事實(shí)。雖然保險(xiǎn)合同的解除在性質(zhì)上與合同法所稱的"合同的解除"并沒有差異,均為合同當(dāng)事人消滅合同約束力所為的法律行為,但保險(xiǎn)合同解除與一般合同解除相比具有解除原因的特殊性、解除后果的不確定性及解除權(quán)時(shí)效的復(fù)雜性。因此,認(rèn)真分析保險(xiǎn)合同解除與一般合同解除的區(qū)別,正確把握保險(xiǎn)合同解除的特征,積極探討解除權(quán)行使的條件,在理論和實(shí)踐中都有重要的意義。
[Abstract]:The dissolution of an insurance contract is a legal fact that the parties to an insurance contract exercise the right to rescind the contract so that the validity of the contract is extinguished. Although the nature of the termination of the insurance contract is not different from that of the "rescission of the contract" as referred to in the contract law, All of them are the legal acts of the parties to the contract to eliminate the binding force of the contract, but the rescission of the insurance contract has the particularity of the reason of the dissolution, the uncertainty of the consequences of the dissolution and the complexity of the limitation of the right of rescission, as compared with the general contract. It is of great significance in theory and practice to carefully analyze the difference between the rescission of insurance contract and that of general contract, correctly grasp the characteristics of the rescission of insurance contract, and actively explore the conditions for the exercise of the right of rescission.
