歐盟保險(xiǎn)合同法的調(diào)和與統(tǒng)一 沈雨青 （對(duì)外經(jīng)濟(jì)貿(mào)易大學(xué)法學(xué)院，北京 100029） ［摘要］對(duì)于成員國(guó)保險(xiǎn)合同法的差異和由此造成的沖突，歐盟一直采用國(guó)際私法的沖 突規(guī)則來(lái)解決。這一方法被認(rèn)為影響了保險(xiǎn)的跨境交易，也使得保險(xiǎn)市場(chǎng)一體化很難實(shí)現(xiàn)。 為了改變這一現(xiàn)狀，歐洲經(jīng)濟(jì)與社會(huì)委員會(huì)提出了“歐洲保險(xiǎn)合同法”的立法建議，而歐洲 委員會(huì)則將保險(xiǎn)合同法作為合同法的一部分，從“歐洲合同法”的層面提出立法建議，其討 論集中于“共同參考框架”。目前，在保留各成員國(guó)保險(xiǎn)合同法的同時(shí)，單獨(dú)出臺(tái)一部歐洲 保險(xiǎn)合同法供合同雙方選擇適用，顯得更為可行。 ［關(guān)鍵詞］歐盟；單一市場(chǎng)；保險(xiǎn)合同；法律適用 ［中圖分類號(hào)］ F841.0 ［文獻(xiàn)標(biāo)識(shí)碼］ A ［文章編號(hào)］1004-3306（2007）08-0093-04 Abstract： Differences of insurance contract laws of member states and the conflicts caused by the differences are always solved by rules of conflicts in private international law in EU, which is regarded as a block to the cross 　 border transactions of insurance and make the single insurance market only stay in paper. In order to improve the situation, EESC submitted an initiative opinion on “European Insurance Contract Law”, while the EC Commission issued two communications on “European Contract Law” which insurance contract was a part of it. The discussions of all these legislative proposals centered on “Common frame of reference of European contract law”. Presently, the “best solution” will be making a European insurance contract law to be chosen freely by contract parties, meanwhile, keeping the insurance contract law of member states.
