【摘要】：在我國現行法律制度框架和國際公約背景下,論述國際航行船舶供應行業(yè)所涉及的主要法律問題,同時輔以案例,深入分析,最后給出關于完善我國國際航行船舶供應行業(yè)的幾點建議。關于該行業(yè)涉及的主要法律問題,文章分三部分展開論述,一是通過論述國際航行船舶供應及其類型,引申出對我國國際航行船舶市場準入和對企業(yè)主體監(jiān)管的法律環(huán)境的分析；二是對我國國際航行船舶供應企業(yè)之供應行為所引發(fā)主要法律問題和法律關系,即行為主體的義務和法律責任分析；三是針對供應企業(yè)遇到的典型民事案例,逐層分析,梳理其中的法律關系和問題所在。最后,文章以對完善我國國際航行船舶供應行業(yè)的幾點建議作為結尾,其中論述了我國和國際船舶供應商協(xié)、會及其規(guī)章規(guī)則,及其對供應企業(yè)發(fā)展的作用。 由于該行業(yè)所具有的涉外性和航運特點,討論我國國際航行船舶供應行業(yè)所涉主要法律問題,勢必需要對相關的國際公約和國際協(xié)會展開討論。在理論層面分析公約,明晰國際公約的含義和原則；在實踐上,將有助于更好的處理供應企業(yè)所面臨的問題。對國際行業(yè)協(xié)會進行討論,有助于我國行業(yè)協(xié)會更好地借鑒成熟經驗,也有助于加強與國際協(xié)會的交流合作,開拓視野,更好的與國際接軌,不斷發(fā)展壯大。 通過以上分析,本文試圖能使讀者,無論是監(jiān)管當局、行業(yè)協(xié)會、供應企業(yè)本身,還是其他相關人士,在我國現行法律制度框架下,對我國國際航行船舶供應行業(yè)有一個比較清晰的認知和了解。從而,也有助于供應企業(yè)加強管理和自律,控制風險、提高競爭力；也助于監(jiān)管當局更加高效地對該行業(yè)的監(jiān)管和引導。
[Abstract]:Under the background of the current legal system framework and international conventions in China, this paper discusses the main legal issues involved in the international navigation ship supply industry, supplemented by a case study, deeply analyzes, and finally gives some suggestions on perfecting the international navigation ship supply industry in China. With regard to the main legal issues involved in this industry, the article is divided into three parts. First, by discussing the supply and types of international navigation ships, this paper extends the analysis of the legal environment for the market access of international navigation ships in China and the supervision of the main body of the enterprise, the second is the analysis of the main legal problems and legal relations caused by the supply behavior of the international navigation ship supply enterprises in China, that is, the obligations and legal responsibilities of the subject of the act. Third, according to the typical civil cases encountered by supply enterprises, layer by layer analysis, combing the legal relationship and problems. Finally, the paper ends with some suggestions on perfecting the supply industry of international navigation ships in China, in which it discusses the association of Chinese and international ship suppliers and its rules and regulations, as well as its role in the development of supply enterprises. Because of the foreign nature and shipping characteristics of the industry, it is necessary to discuss the relevant international conventions and international associations to discuss the main legal issues involved in the supply industry of international navigation ships in China. At the theoretical level, it is necessary to analyze the conventions and clarify the meaning and principles of the international conventions. In practice, it will help to better deal with the problems faced by the supply enterprises. The discussion of the international trade association will help the trade association of our country to draw lessons from the mature experience, and also help to strengthen the exchange and cooperation with the international association, broaden the field of vision, better connect with the international community, and continue to develop and grow. Through the above analysis, this paper attempts to make readers, whether regulatory authorities, trade associations, supply enterprises themselves, or other relevant people, under the framework of the current legal system of our country, have a clear understanding and understanding of the international navigation ship supply industry in our country. Thus, it will also help supply enterprises to strengthen management and self-discipline, control risk and improve competitiveness, and also help regulators to regulate and guide the industry more efficiently.
