【摘要】：隨著經(jīng)濟(jì)的快速發(fā)展、國(guó)際交流途徑的增多,一些經(jīng)濟(jì)犯罪和職務(wù)犯罪等犯罪嫌疑人在出逃前已將贓款贓物轉(zhuǎn)移至境外,導(dǎo)致大量國(guó)有財(cái)產(chǎn)流失,嚴(yán)重?fù)p害了公民、法人及其他組織的合法權(quán)益。據(jù)國(guó)家社科規(guī)劃項(xiàng)目《中國(guó)懲治和預(yù)防腐敗重大對(duì)策研究》課題組的調(diào)查顯示,中國(guó)當(dāng)前約有4000多名外逃官員,在過(guò)去的30年中,這些外逃貪官卷走了500多億美元的資金。為了有效遏制這種態(tài)勢(shì)的蔓延,我國(guó)公安部于2014年7月22日部署開(kāi)展了“獵狐2014”專項(xiàng)行動(dòng),拉開(kāi)了緝捕境外在逃經(jīng)濟(jì)犯罪嫌疑人的序幕。通過(guò)這次專項(xiàng)行動(dòng),不僅有680名外逃官員在同年年底落網(wǎng),大量的贓款也得以追回。與此同時(shí),我國(guó)境外追逃追贓制度的運(yùn)行機(jī)制障礙也逐漸暴露出來(lái),大批犯罪嫌疑人仍然逍遙法外,違法所得依然散落于境外。因此,完善境外追逃追贓國(guó)際警務(wù)合作機(jī)制,已經(jīng)成為現(xiàn)實(shí)最為緊迫的任務(wù)。論文共分為五個(gè)部分：第1章闡明了境外追逃追贓警務(wù)合作的背景和意義,回顧并評(píng)述了國(guó)內(nèi)外相關(guān)文獻(xiàn),并提出論文的研究思路和研究方法。第2章解讀了境外追逃、境外追贓、國(guó)際警務(wù)合作的概念,分析了國(guó)際警務(wù)合作的平臺(tái)和機(jī)制。第3章全面評(píng)述了境外追逃追贓國(guó)際警務(wù)合作的指導(dǎo)原則及法律依據(jù),分別從國(guó)際法律依據(jù)和國(guó)內(nèi)法律依據(jù)兩個(gè)方面進(jìn)行系統(tǒng)化梳理。第4章把握了境外追逃追贓國(guó)際警務(wù)合作運(yùn)行的脈絡(luò),主要包括合作的網(wǎng)狀系統(tǒng)、合作途徑、合作模式、合作流程,并分析了其發(fā)展趨勢(shì)。第5章以社會(huì)工程的視角提出境外追逃追贓國(guó)際警務(wù)合作機(jī)制的現(xiàn)實(shí)困境及運(yùn)行機(jī)制改革,指出跨國(guó)犯罪的情報(bào)和數(shù)據(jù)交換機(jī)制不暢通,境外取證國(guó)際警務(wù)合作困難等問(wèn)題。同時(shí)建議從國(guó)情及外交關(guān)系出發(fā)、兼顧國(guó)家政治、經(jīng)濟(jì)、文化和軍事實(shí)力建立信息共享機(jī)制,加強(qiáng)取證司法合作機(jī)制,構(gòu)建跨境追捕之特色機(jī)制,建立沒(méi)收所得收益分享機(jī)制,加強(qiáng)國(guó)際化金融犯罪監(jiān)檢合作體制等以解決上述問(wèn)題。
[Abstract]:With the rapid development of economy and the increase of international communication channels, some criminal suspects, such as economic crimes and job-related crimes, have transferred the stolen money and stolen goods to foreign countries before they fled, resulting in the loss of a large number of state-owned property and the serious damage to citizens. The legal rights and interests of legal persons and other organizations. According to a survey by the research group of the State Social Science Planning Project "China's Major Countermeasures to punish and prevent Corruption", there are currently more than 4000 flight officials in China, and in the past 30 years, these corrupt officials have taken away more than $50 billion in funds. In order to effectively curb the spread of this situation, the Ministry of Public Security deployed a special "Fox hunting 2014" operation on July 22, 2014, which opened the prelude to arrest the economic criminal suspects who are at large abroad. As a result of the operation, 680 escape officials were arrested at the end of the same year, and large amounts of stolen money were recovered. At the same time, the obstacles to the operation mechanism of the system of pursuing and chasing stolen goods outside our country are gradually exposed, a large number of suspects are still at large, and the illegal proceeds are still scattered abroad. Therefore, it has become the most urgent task to perfect the international police cooperation mechanism. The thesis is divided into five parts: chapter 1 clarifies the background and significance of overseas pursuit and pursuit of stolen goods police cooperation, reviews and comments on the relevant literature at home and abroad, and puts forward the research ideas and research methods. Chapter 2 interprets the concepts of overseas pursuit, overseas pursuit and international police cooperation, and analyzes the platform and mechanism of international police cooperation. Chapter 3 gives a comprehensive review of the guiding principles and legal basis of international police cooperation in pursuit and pursuit of stolen goods, respectively from the two aspects of international legal basis and domestic legal basis. Chapter 4 holds the context of international police cooperation, including the network system of cooperation, the way of cooperation, the mode of cooperation, the process of cooperation, and analyzes its development trend. The fifth chapter puts forward the realistic predicament and the reform of the international police cooperation mechanism from the perspective of social engineering, and points out that the information and data exchange mechanism of transnational crime is not smooth, and the international police cooperation is difficult to obtain evidence from abroad. At the same time, it is suggested that from the perspective of national conditions and diplomatic relations, we should take account of national political, economic, cultural and military strength to establish a mechanism for information sharing, strengthen the mechanism of judicial cooperation in the collection of evidence, build a special mechanism for cross-border manhunt, and establish a mechanism for sharing the proceeds of confiscation. Strengthen the international financial crime supervision and inspection cooperation system to solve the above problems.
