【摘要】：由于國際上各國船舶登記制度不統(tǒng)一，導致了方便旗船舶普遍興起。這一現(xiàn)象對采用嚴格登記制度國家的船舶監(jiān)管、海難事故管轄、海洋環(huán)境保護等諸多方面都造成了嚴重的負面影響。在歐洲的傳統(tǒng)海運大國苦苦尋求因這種制度不統(tǒng)一而帶來的各項困境的解決辦法之時，第二船舶登記制度應運而生。在英國1978年率先開始實行該制度后，法國、荷蘭、葡萄牙、挪威等多個國家相繼實行了該制度。經(jīng)過多年的實踐表明，該制度對于解決這些國家的船舶登記流向問題確實起到了很大的作用。近年來,我國也面臨著船籍外流現(xiàn)象嚴重的困境，為解決現(xiàn)狀，理論界提出了很多的見解，其中第二船舶登記制度為很多學者所提倡，但關于我國是否完全具備了實行第二船舶登記制度的環(huán)境，，并未得出突破性的結論。因此，本文在吸取和借鑒眾多優(yōu)秀理論成果的基礎上，立足于對第二船舶登記制度本身的特征進行研究，比較借鑒國外實行第二船舶登記制度的先進經(jīng)驗和失敗教訓，分析了我國實行第二船舶登記制度的可行性，并最終提出了完善我國船舶登記制度的建議。 在結構安排上，本文采用了碩士畢業(yè)論文的一般形式：界定基本概念——分析動因——考察實施效果——分析第二船舶登記制度在我國實施的可行性——提出我國船舶登記制度的完善建議。除引言和結語外，正文一共五個部分。 第一部分“第二船舶登記制度概述”。本部分介紹了船舶登記制度的相關概念，闡述了第二船舶登記制度的含義及來源，為下文的研究奠定了基礎。 第二部分“第二船舶登記制度興起之動因分析”。筆者從國際上方便旗船舶盛行帶來的危害入手，通過對“方便旗”現(xiàn)象及其帶來的弊端進行分析，結合國際上統(tǒng)一船舶登記制度的困難，概述了各國船舶登記制度不統(tǒng)一的現(xiàn)狀以及國際上為統(tǒng)一船舶登記制度所做的相關努力。導引出第二船舶登記制度出現(xiàn)的背景。 第三部分“第二船舶登記制度之主要類型及特征分析”。通過對國際上出現(xiàn)的第二船舶登記制度的兩種類型——離岸船舶登記制度和國際船舶登記制度的比較研究，以舉例的方式詳細分析了各自的特征，并歸納出兩者的優(yōu)劣。 第四部分“第二船舶登記制度實施效應分析”。通過對第二船舶登記制度在國際上部分國家多年以來的實踐效果考察，總結了第二船舶登記制度的正面效應，也客觀分析了第二船舶登記制度對登記國造成的各項負面效應，為我國船舶登記制度完善方法的選擇提供了理論參考。 第五部分“中國船舶登記制度之完善建議”。筆者通過對我國船舶登記制度的現(xiàn)狀以及存在的不足方面進行分析，結合理論界關于改革我國船舶登記制度的各項理論建設以及我國進行的噸稅制試點等實踐，研究了第二船舶登記制度在我國實行的可行性，并提出了中國船舶登記制度的完善建議。 最后，結語部分簡要的概括和總結了文中內(nèi)容。
[Abstract]:Because the international ship registration system is not uniform, it has resulted in the general rise of convenient flag ships. This phenomenon has a serious negative impact on ship supervision, maritime accident jurisdiction and marine environmental protection in strict registration system countries. The second ship registration system came into being when the traditional maritime giant in Europe struggled to find a solution to the difficulties arising from the inconsistency of such a system. After the introduction of the system in 1978, France, the Netherlands, Portugal and Norway have successively implemented the system. After years of practice, the system has played a great role in solving the problem of ship registration and flow in these countries. In recent years, China also faces a serious dilemma of the outflow of ships. In order to solve the present situation, many opinions have been put forward in the theoretical circle, among which, the second ship registration system has been advocated by many scholars, but with regard to whether our country fully has the environment for carrying out the second ship registration system, There was no breakthrough conclusion.
