【摘要】：中國在南海地區(qū)南沙群島海域的島礁建設(shè)活動所產(chǎn)生的環(huán)境影響引起了國際社會的廣泛關(guān)注�！堵�(lián)合國海洋法公約》中并沒有對島礁建設(shè)活動的環(huán)境要求作出具體規(guī)定,卻對各國施加了保護(hù)和保全海洋環(huán)境的一般性義務(wù)、合作以及環(huán)境影響評價(jià)的義務(wù)。由于公約本身的局限性,導(dǎo)致中國在南沙島礁建設(shè)中的海洋環(huán)境保護(hù)和保全的一般義務(wù)具有不確定性。因此,論題將從國際法角度研判和解讀中國在南海的島礁建設(shè)活動是否符合相關(guān)的國際環(huán)境保護(hù)的規(guī)定、需要承擔(dān)何種海洋環(huán)境保護(hù)和保全的義務(wù),為中國在南海島礁建設(shè)活動的順利開展和完善提供堅(jiān)實(shí)的理論基礎(chǔ)。
[Abstract]:The environmental impact of China's construction activities on islands and reefs in the Nansha Islands area of the South China Sea has aroused widespread concern of the international community. The United Nations Convention on the Law of the Sea does not specify the environmental requirements for the construction of islands and reefs. It imposes a general obligation on States to protect and preserve the marine environment, a duty to cooperate and an environmental impact assessment. Due to the limitations of the Convention itself, China's general obligation to protect and preserve the marine environment in the construction of Nansha Islands and reefs is uncertain. Therefore, from the perspective of international law, the topic will study and interpret whether China's island and reef construction activities in the South China Sea are in conformity with the relevant international environmental protection provisions, and what kind of obligations to protect and preserve the marine environment should be assumed. To provide a solid theoretical basis for the smooth development and improvement of China's construction activities in the South China Sea islands and reefs.
