論國際法的政治基礎

【作者簡介】楊澤偉（1968—），男，湖南新寧人，武漢大學法學院教師，教授，博士生導師，，兼任中國國際法學會理事，中國歐洲學會歐洲法律研究會常務理事，湖北省法學會常務理事。

【摘要】國際法與國際政治之間存在一種相互強化和相互滲透的關系。一方面，自國際法產(chǎn)生以來，國際法的發(fā)展時常受到國際政治的制約；另一方面，國際法一經(jīng)確立就對國際政治關系產(chǎn)生重要影響。在未來的國際體系中，國際法將逐步擺脫強權政治的束縛，作用也會更加突出。

【英文摘要】A mutual strengthening and infiltration relationship exists between international law and international politics．On one hand，the development of international law is usually restricted by

international politics since it arose；on the other hand，the international law exerts important influence upon the international political relationship．The international law will gradually shake off the yoke of the power politics and furthermore its role will also be strengthened in the future international system．

國際法與國際政治的交互關系，是一個極為重要但也是常被忽略或誤解的問題。{1}（P6）自國際法產(chǎn)生以來，國際法的發(fā)展時常受到國際政治的制約和影響。因此，研究國際法與國際政治的相互關系問題，對于了解世界發(fā)展趨勢、推動國際法的發(fā)展以及建立國際新秩序，都具有十分重要的意義。
