【摘要】:沉船強(qiáng)制打撈費(fèi)用問(wèn)題一直是困擾海事主管機(jī)關(guān)的核心問(wèn)題之一。隨著人類海洋活動(dòng)的日益頻繁和國(guó)際貿(mào)易的日益發(fā)展,船舶的運(yùn)用以及沉沒(méi)后帶來(lái)的問(wèn)題也日益復(fù)雜化。關(guān)于沉船強(qiáng)制打撈費(fèi)用的問(wèn)題在國(guó)際公約和國(guó)內(nèi)立法都缺乏完整的法律規(guī)定且零散陳舊,給司法實(shí)踐帶來(lái)很大的不方便。目前我國(guó)學(xué)者在這一方面作為專題研究非常少,因此,筆者在此綜合運(yùn)用經(jīng)濟(jì)學(xué)以及比較的分析方法等,針對(duì)沉船強(qiáng)制打撈費(fèi)用的實(shí)現(xiàn)途徑,分析、借鑒國(guó)外立法的理論基礎(chǔ)和實(shí)踐經(jīng)驗(yàn),對(duì)我國(guó)實(shí)現(xiàn)沉船強(qiáng)制打撈費(fèi)用的實(shí)現(xiàn)提出了一套完善的建議。 文章共分為四章。第一章為“沉船強(qiáng)制打撈相關(guān)概念界定”,即探討沉船和強(qiáng)制打撈的基本概念。首先,通過(guò)對(duì)國(guó)外法律關(guān)于沉船概念的闡述,從宏觀方面了解沉船這一概念的演變的趨勢(shì),并在此基礎(chǔ)上界定了沉船和沉船強(qiáng)制打撈的兩個(gè)概念。 第二章為“沉船強(qiáng)制打撈費(fèi)用爭(zhēng)議法律問(wèn)題分析”。這一章主要針對(duì)與沉船強(qiáng)制打撈費(fèi)用聯(lián)系密切的三個(gè)問(wèn)題展開,第一問(wèn)題是沉船強(qiáng)制打撈中各方當(dāng)事人的法律關(guān)系;第二問(wèn)題是沉船強(qiáng)制打撈費(fèi)用的責(zé)任主體;第三問(wèn)題是沉船強(qiáng)制打撈費(fèi)用的法律性質(zhì),通過(guò)對(duì)這三個(gè)問(wèn)題的分析和提出筆者的觀點(diǎn),旨在為下文完善我國(guó)相關(guān)立法作好鋪墊。 第三章為“沉船強(qiáng)制打撈費(fèi)用實(shí)現(xiàn)的可行性分析”,主要從理論和實(shí)踐兩個(gè)方面分析沉船強(qiáng)制打撈費(fèi)用實(shí)現(xiàn)的可行性,這也是本文創(chuàng)新之處,通過(guò)理論聯(lián)系實(shí)踐的方式使文章主題顯得更加深刻。 第四章為“我國(guó)有關(guān)沉船強(qiáng)制打撈費(fèi)用實(shí)現(xiàn)存在的問(wèn)題及對(duì)策”,這部分是文章的重點(diǎn)。第四章整體的寫作思路是指出我國(guó)現(xiàn)行法律規(guī)定關(guān)于有關(guān)沉船強(qiáng)制打撈費(fèi)用實(shí)現(xiàn)的不足之處,在借鑒國(guó)外立法經(jīng)驗(yàn)的基礎(chǔ)上,對(duì)我國(guó)有關(guān)沉船強(qiáng)制打撈費(fèi)用實(shí)現(xiàn)的立法提出一系列可行性建議:即設(shè)立一套合理的實(shí)現(xiàn)沉船強(qiáng)制打撈費(fèi)用的保障機(jī)制。 通過(guò)本文的論述,筆者認(rèn)為在完善我國(guó)相關(guān)立法的過(guò)程中,要以注重問(wèn)題解決為重點(diǎn),同時(shí)多關(guān)注國(guó)際動(dòng)態(tài),努力做到與國(guó)際步調(diào)保持一致,以更好地解決沉船強(qiáng)制打撈費(fèi)用中存在的各種問(wèn)題。
[Abstract]:The problem of compulsory salvage cost of sunken ship has been one of the core problems puzzling maritime authorities. With the increasing frequency of human ocean activities and the development of international trade, the use of ships and the problems brought by sunken ships are becoming more and more complicated. The problem of compulsory salvage cost of sunken ship is lack of complete legal provisions in international conventions and domestic legislation, which brings great inconvenience to judicial practice. At present, there are very few scholars in our country who study on this aspect as a special topic. Therefore, the author makes a comprehensive use of economics and comparative analysis methods, and analyzes the ways to realize the cost of compulsory salvage of sunken ships. Based on the theoretical basis and practical experience of foreign legislation, this paper puts forward a set of perfect suggestions for the realization of compulsory salvage cost of sunken ship in China. The article is divided into four chapters. The first chapter is the definition of the related concepts of forced salvage of sunken ship, that is, the basic concepts of sunken ship and forced salvage. First of all, through the elaboration of the concept of sunken ship in foreign law, the evolution trend of the concept of sunken ship is understood from the macroscopic aspect, and on this basis, two concepts of sunken ship and sunken ship forced salvage are defined. The second chapter is an analysis of the legal issues concerning the disputes over the cost of compulsory salvage of sunken ships. This chapter mainly focuses on three issues which are closely related to the cost of compulsory salvage of sunken ship. The first problem is the legal relationship between the parties involved in the compulsory salvage of sunken ship, the second is the subject of responsibility for the cost of compulsory salvage of sunken ship. The third problem is the legal nature of the cost of compulsory salvage of sunken ships. Through the analysis of these three problems and the author's point of view, the purpose of this paper is to lay the groundwork for perfecting the relevant legislation of our country. The third chapter is "the feasibility analysis of realizing the cost of forced salvage of sunken ship", which mainly analyzes the feasibility of realizing the cost of compulsory salvage of sunken ship from two aspects of theory and practice, which is also the innovation of this paper. Through the combination of theory and practice, the theme of the article appears to be more profound. The fourth chapter is "problems and countermeasures of realizing the cost of compulsory salvage of sunken ship in our country", which is the focus of the article. The fourth chapter of the overall thinking of writing is to point out the current laws of our country on the implementation of mandatory salvage costs of shipwreck deficiencies, on the basis of foreign legislative experience, This paper puts forward a series of feasible suggestions on the legislation of realizing the compulsory salvage cost of sunken ship in our country: that is, to set up a set of reasonable safeguard mechanism to realize the cost of compulsory salvage of sunken ship. Through the discussion of this paper, the author thinks that in the process of perfecting the relevant legislation of our country, we should pay more attention to the problem solving, at the same time, pay more attention to the international situation, and strive to keep consistent with the international step. In order to better solve the various problems existing in the cost of forced salvage of sunken ships.
