【摘要】：經(jīng)濟(jì)全球化與金融自由化向縱深發(fā)展強(qiáng)化了以避險(xiǎn)、套利及投機(jī)為目的的國(guó)際游資在全球的游動(dòng)。國(guó)際游資的虛擬性、高杠桿性嚴(yán)重威脅著各個(gè)主權(quán)國(guó)家的經(jīng)濟(jì)安全，具有極大的風(fēng)險(xiǎn)性和對(duì)于宏觀經(jīng)濟(jì)的破壞力。 總攬世界各國(guó)對(duì)國(guó)際游資的法律規(guī)制，美國(guó)金融監(jiān)管體系較為完善，尤其金融危機(jī)后針對(duì)國(guó)際游資的規(guī)范更為周密；發(fā)展中國(guó)家中，智利在管制游資流動(dòng)方面亦有獨(dú)到之處。相比之下，我國(guó)則較為薄弱。 金融危機(jī)后，全球經(jīng)濟(jì)的低迷和中國(guó)經(jīng)濟(jì)的快速發(fā)展呈現(xiàn)鮮明對(duì)比，國(guó)際游資為了保值、增值不斷流入以中國(guó)為代表的新興經(jīng)濟(jì)體，國(guó)際游資在新興經(jīng)濟(jì)體中的規(guī)模龐大，對(duì)新興經(jīng)濟(jì)體的經(jīng)濟(jì)安全威脅越來(lái)越大。中國(guó)應(yīng)盡快完善現(xiàn)有規(guī)制國(guó)際游資的法律，以最大程度減少國(guó)際游資的投機(jī)行為可能帶來(lái)的負(fù)面影響，將國(guó)際游資“圈”在有利于我國(guó)經(jīng)濟(jì)發(fā)展的領(lǐng)域。 論文第一部分首先對(duì)國(guó)際游資進(jìn)行了界定。全面分析了國(guó)際游資的主體、特征、對(duì)世界經(jīng)濟(jì)與民族國(guó)家經(jīng)濟(jì)的利和弊。在此基礎(chǔ)上，論文第二部分全面考察了目前世界各國(guó)中對(duì)國(guó)際游資監(jiān)管情況，并重點(diǎn)評(píng)析了極具代表性的美國(guó)和智利規(guī)制國(guó)際游資的法律。論文第三部分對(duì)規(guī)制國(guó)際游資的國(guó)際法律進(jìn)行了系統(tǒng)考察，并在深入分析國(guó)際游資國(guó)際法律規(guī)制必要性的基礎(chǔ)上，，著重考察了國(guó)際貨幣基金組織、巴塞爾國(guó)際銀行業(yè)監(jiān)管委員會(huì)和國(guó)際證監(jiān)會(huì)組織的監(jiān)管實(shí)踐。論文第四部分對(duì)國(guó)際游資在中國(guó)的現(xiàn)狀進(jìn)行了全面考察，分析指出目前存在的問(wèn)題，并在前三個(gè)部分綜合研究的基礎(chǔ)上，系統(tǒng)地提出了構(gòu)建和完善我國(guó)規(guī)制國(guó)際游資法律的建議。
[Abstract]:The deep development of economic globalization and financial liberalization has strengthened the global movement of international hot money for the purpose of avoiding risks, arbitrage and speculation. The fictitious nature and high leverage of international hot money seriously threaten the economic security of various sovereign countries, and have great risk and destructive power to the macro economy. The United States financial supervision system is relatively perfect, especially after the financial crisis, the norms for international hot money are more thorough. Among the developing countries, Chile has its own characteristics in controlling the flow of hot money. In contrast, our country is relatively weak. After the financial crisis, the global economic downturn and the rapid development of China's economy are in sharp contrast. In order to preserve their value and increase their value, international hot money continues to flow into emerging economies represented by China. The scale of international hot money in emerging economies is huge. Economic security threats to emerging economies are growing. China should improve the existing laws to regulate international hot money as soon as possible, in order to minimize the possible negative impact of speculation of international hot money, and put the international hot money "circle" in the field beneficial to the economic development of our country. The first part of the paper defines the international hot money. This paper comprehensively analyzes the main body and characteristics of international hot money and its advantages and disadvantages to the world economy and the national economy. On this basis, the second part of the paper comprehensively examines the current international supervision of hot capital in the world, and focuses on the representative laws of the United States and Chile to regulate international hot money. The third part of the thesis makes a systematic investigation on the international law of regulating international hot money, and on the basis of in-depth analysis of the necessity of international legal regulation of international hot money, focuses on the International Monetary Fund. The practice of the Basel International Banking Supervision Committee and the International Organization of Securities Regulatory Commission. The fourth part of the paper makes a comprehensive investigation on the current situation of international hot money in China, analyzes and points out the existing problems, and on the basis of the first three parts of the comprehensive study, The suggestions of constructing and perfecting the international floating capital law in China are put forward systematically.
