【摘要】：19世紀(jì)末,在日本聲索對(duì)釣魚島進(jìn)行"無主地先占"之前,中國與琉球王國長達(dá)數(shù)百年的正式交往中已然形成了沖繩海槽作為中琉傳統(tǒng)海界的歷史事實(shí)。通過對(duì)中琉傳統(tǒng)海界的確認(rèn),強(qiáng)化了中國依據(jù)時(shí)際法對(duì)釣魚島的"無主地先占",明確了《馬關(guān)條約》將釣魚島作為臺(tái)灣附屬島嶼割讓予日本的事實(shí),輔證了二戰(zhàn)后相關(guān)國際條約將我國對(duì)釣魚島的主權(quán)所做的申明。
[Abstract]:At the end of the 19th century, before the Japanese sonant took possession of the Diaoyu Islands, the historical fact that the Okinawa trough was the traditional boundary between China and Ryukyu had been formed in the hundreds of years of official exchanges between China and Ryukyu Kingdom. Through the confirmation of the traditional maritime boundary between China and Ryukyu, it has strengthened China's "preemptive occupation" of the Diaoyu Islands in accordance with the intertemporal law, and clarified the fact that the Diaoyu Islands were ceded to Japan by the "Treaty of the people's Republic of China" as a subsidiary of Taiwan. Supporting the relevant international treaties after World War II, China's sovereignty over the Diaoyu Islands.
