【摘要】：近年來(lái),ICSID仲裁庭管轄權(quán)裁決出現(xiàn)平穩(wěn)增加的趨勢(shì)。管轄權(quán)是ICSID仲裁庭得以作出有效裁決的基石,投資者和東道國(guó)也往往在進(jìn)入實(shí)體爭(zhēng)議之前首先就管轄權(quán)問(wèn)題爭(zhēng)鋒相對(duì)。通過(guò)對(duì)近十年來(lái)ICSID仲裁庭的管轄權(quán)裁決進(jìn)行分析,特別是結(jié)合公約內(nèi)容中相關(guān)要件的規(guī)定,管轄權(quán)裁決的特征和趨勢(shì)逐漸顯露�？疾焱斫麵CSID仲裁庭管轄權(quán)裁決,有助于分析ICSID仲裁庭自身的運(yùn)作機(jī)制,積累實(shí)踐案例經(jīng)驗(yàn),對(duì)于我國(guó)首次作為被申訴方參與ICSID進(jìn)行管轄權(quán)抗辯也具有較強(qiáng)的啟示作用。
[Abstract]:In recent years, the jurisdiction of ICSID arbitral tribunal has a steady increasing trend. Jurisdiction is the cornerstone of the ICSID arbitral tribunal to make an effective decision. Investors and host countries often compete on jurisdiction issues before entering substantive disputes. Through the analysis of the jurisdiction award of the ICSID arbitral tribunal in the past ten years, especially the provisions of the relevant elements in the content of the convention, the characteristics and trends of the jurisdiction award are gradually revealed. It is helpful to analyze the operation mechanism of ICSID arbitral tribunal and accumulate practical case experience. It also has a strong enlightening effect for our country to participate in the defense of jurisdiction of ICSID for the first time as the respondent party.
