南極旅游國(guó)際海事法律規(guī)制研究

【摘要】:20世紀(jì)90年代開始,南極商業(yè)旅游迅速發(fā)展。南極旅游是一種完全異質(zhì)于其他模式的旅游:不由政府直接管理或主要資助、無接待國(guó)或旅游目的地國(guó)、無任何直接的旅游管理者和旅游服務(wù)設(shè)施、不存在刺激當(dāng)?shù)亟?jīng)濟(jì)發(fā)展的問題等,且與南極權(quán)利主張、極地規(guī)則制定話語權(quán)、南極科考秩序等緊密相連,南極旅游的交通工具主要是通過游船進(jìn)行,因而也帶來了南極航行安全和環(huán)境安全問題,所以,研究南極旅游的海事法律規(guī)制問題顯得尤為重要。本文主要是通過對(duì)南極旅游國(guó)際海事法律規(guī)則和國(guó)別法律規(guī)則的分析,發(fā)現(xiàn)目前規(guī)制南極旅游的國(guó)際海事法律起不到有效監(jiān)管的作用,通過剖析南極旅游國(guó)際海事法律規(guī)則的未來發(fā)展趨勢(shì),得出南極旅游的未來海事規(guī)則發(fā)展還需要以南極條約協(xié)商會(huì)議作為主導(dǎo)力量,以港口國(guó)監(jiān)管、IAATO等國(guó)際組織協(xié)作為輔助,將規(guī)制對(duì)象擴(kuò)大到方便旗船現(xiàn)象、非締約國(guó)經(jīng)營(yíng)人等,進(jìn)而為豐富我國(guó)南極旅游、南極環(huán)境保護(hù)等法律規(guī)則研究提供借鑒,進(jìn)一步提升我國(guó)在南極規(guī)則制定上的話語權(quán)。
[Abstract]:Since the 1990 s, commercial tourism in Antarctica has developed rapidly. Antarctic tourism is a type of tourism that is completely different from other modes of tourism: it is not directly regulated or funded by governments, it is not hosted or destination countries, it does not have any direct tourism management and tourism service facilities, There is no problem of stimulating local economic development, and it is closely linked to the claims of Antarctic rights, the right to say polar rules, and the order of Antarctic scientific research. The means of transportation for Antarctic tourism are mainly carried out through cruise ships. Therefore, it is very important to study the maritime legal regulation of Antarctic tourism. Based on the analysis of the international maritime laws and regulations of Antarctic tourism, this paper finds that the international maritime laws that regulate Antarctic tourism do not play an effective role in regulating Antarctic tourism. By analyzing the future development trend of international maritime laws and regulations for Antarctic tourism, it is concluded that the future development of maritime rules for Antarctic tourism should also be supported by the Antarctic Treaty Consultative meeting as the leading force and the cooperation of international organizations such as Port State Control and IAATO. The object of regulation is extended to convenient flag ship phenomenon, non-signatory operators and so on, thus providing reference for enriching the study of legal rules such as Antarctic tourism and Antarctic environmental protection in China, and further enhancing the right to speak on the making of Antarctic rules in our country.
