【摘要】:經(jīng)濟(jì)全球化使國(guó)際貿(mào)易領(lǐng)域的競(jìng)爭(zhēng)不斷加劇,中國(guó)作為一個(gè)新興的貿(mào)易大國(guó),早已成為世界貿(mào)易摩擦的主戰(zhàn)場(chǎng)。從1995-2009年,我國(guó)已經(jīng)連續(xù)15年位居世界反傾銷之首。隨著中國(guó)貿(mào)易大國(guó)地位的確立,越來越多的國(guó)家利用反傾銷,限制我國(guó)產(chǎn)品的輸入,對(duì)我國(guó)的出口產(chǎn)業(yè)造成了重大的損失,阻礙了我國(guó)對(duì)外貿(mào)易快速、健康的發(fā)展。本文從我國(guó)遭受反傾銷的現(xiàn)狀入手,利用大量數(shù)據(jù)分析造成這種結(jié)果的原因,給我國(guó)造成的損害,結(jié)合我國(guó)在反傾銷實(shí)踐中的案例,最終總結(jié)出應(yīng)對(duì)措施。 我國(guó)出口市場(chǎng)單一,出口產(chǎn)品的價(jià)格低廉,容易給進(jìn)口國(guó)造成傾銷的印象。加上我國(guó)出口結(jié)構(gòu)不合理,產(chǎn)品附加值低,更有無良商人惡意低價(jià)競(jìng)爭(zhēng),越來越多的國(guó)家對(duì)我國(guó)商品進(jìn)行反傾銷調(diào)查。在外國(guó)的反傾銷調(diào)查中,歐盟、美國(guó)等西方發(fā)達(dá)國(guó)家將我國(guó)定位為“非市場(chǎng)經(jīng)濟(jì)國(guó)家”,使用“替代國(guó)”計(jì)算我國(guó)的傾銷幅度,這是對(duì)我國(guó)貿(mào)易歧視的做法。我國(guó)政府應(yīng)該利用我國(guó)在世界貿(mào)易組織的影響力,盡快取得“市場(chǎng)經(jīng)濟(jì)地位”,調(diào)整經(jīng)濟(jì)結(jié)構(gòu),鼓勵(lì)企業(yè)發(fā)展技術(shù)含量高的產(chǎn)業(yè)。為了更好的應(yīng)對(duì)反傾銷,我國(guó)政府部門、行業(yè)協(xié)會(huì)和企業(yè)應(yīng)該共同合作,建立反傾銷預(yù)警機(jī)制,對(duì)重點(diǎn)國(guó)家、重點(diǎn)產(chǎn)品進(jìn)行跟蹤調(diào)查;設(shè)立反傾銷應(yīng)訴基金,為應(yīng)訴企業(yè)消除顧慮,主動(dòng)的應(yīng)對(duì)國(guó)外對(duì)我國(guó)的反傾銷投訴。 能否建立起完善的反傾銷法律體系是我國(guó)從根本上解決反傾銷問題的關(guān)鍵所在,雖然早在1994年我國(guó)《對(duì)外貿(mào)易法》就將反傾銷納入了法律體系,但是和西方發(fā)達(dá)國(guó)家相比,我國(guó)反傾銷法律的規(guī)定不夠詳盡,可操作性也比較差。筆者將我國(guó)《反傾銷條例》和世界貿(mào)易組織的《反傾銷協(xié)議》作比較,指出我國(guó)法律實(shí)體和程序方面的不足,并就我國(guó)反傾銷法律的修訂給出了建議。
[Abstract]:Economic globalization has intensified competition in the field of international trade. As a new trading power, China has long been the main battleground of world trade friction.From 1995-2009, China has been the first anti-dumping country in the world for 15 years in a row. With the establishment of China's status as a trading power, more and more countries have made use of anti-dumping to restrict the import of Chinese products, which has caused great losses to China's export industry. It hinders the rapid and healthy development of China's foreign trade. Starting with the current situation of anti-dumping in China, this paper analyzes the causes of this result by using a large number of data, and the damage caused to our country, combining with the cases in the practice of anti-dumping in China. Finally summed up the response measures. China's export market is single, and the price of its export products is low, which easily creates the impression of dumping in the importing countries. In addition, China's export structure is unreasonable, the added value of products is low, and there are even more unscrupulous businessmen who compete for low prices with malicious intent. More and more countries are conducting anti-dumping investigations on Chinese commodities. In foreign anti-dumping investigations, the European Union, the United States and other western developed countries have positioned China as a "non-market economy country" and used "surrogate countries" to calculate the dumping margin of our country. This is a practice of discriminating against China's trade. Our government should make use of our influence in the World Trade Organization to get "market economy status" as soon as possible and readjust the economic structure. To encourage enterprises to develop high-technology industries. In order to better deal with anti-dumping, our government departments, trade associations and enterprises should work together to establish an anti-dumping early warning mechanism to track and investigate key countries and key products. To set up the anti-dumping response fund, to eliminate the concerns of the responding enterprises, and to deal with the anti-dumping complaints from foreign countries. Whether or not we can establish a perfect anti-dumping legal system is the key to solve the anti-dumping problem fundamentally in our country. Although as early as 1994, our country's Foreign Trade Law brought anti-dumping into the legal system, but compared with the western developed countries, The provisions of antidumping laws in our country are not detailed enough, and their maneuverability is also relatively poor. The author compares China's Anti-dumping regulations with the World Trade Organization's Anti-dumping Agreement, and points out the deficiencies in our country's legal entities and procedures. Suggestions on the revision of anti-dumping laws in China are also given.
