【摘要】：1949年以來(lái),中國(guó)司法經(jīng)歷了某種范式性轉(zhuǎn)變。法理學(xué)教材中的法律適用理論為這種轉(zhuǎn)變奠定了最一般的理論基礎(chǔ),從而可以將中國(guó)司法理論的轉(zhuǎn)變概括為從強(qiáng)制型司法到權(quán)威型司法的轉(zhuǎn)變。強(qiáng)制型司法的母體是20世紀(jì)40年代和20世紀(jì)50年代蘇聯(lián)的法律適用理論,中國(guó)法理學(xué)在繼承這一理論母體的基礎(chǔ)上,形成了強(qiáng)制型司法,它具有強(qiáng)制性、工具性和階級(jí)性。從20世紀(jì)80年代下半期到20世紀(jì)90年代中期,強(qiáng)制型司法逐漸演變?yōu)闄?quán)威型司法。權(quán)威型司法具有權(quán)威性、目的性和專業(yè)性。當(dāng)前,權(quán)威型司法仍面臨著一些需要解答的問(wèn)題,因而也存在進(jìn)一步完善的空間。
[Abstract]:Since 1949, China's judiciary has undergone a paradigm shift. The theory of application of law in jurisprudence textbooks lays the most general theoretical basis for this change, thus the transformation of Chinese judicial theory can be summarized as the transformation from compulsory to authoritative justice. The mother of compulsory justice is the applicable theory of law in the Soviet Union in the 1940s and 1950s. On the basis of inheriting this theory, Chinese jurisprudence has formed the compulsory judicature, which has the characteristics of compulsion, instrumentality and class. From the second half of 1980's to the middle of 1990's, compulsory judicature gradually evolved into authoritative judicature. The authoritative judicature is authoritative, purposeful and professional. At present, authoritative judicature still faces some questions that need to be solved, so there is room for further improvement.
