我國網(wǎng)絡(luò)司法拍賣制度及其完善

【摘要】:隨著互聯(lián)網(wǎng)技術(shù)的逐漸成熟和網(wǎng)絡(luò)交易的普及,網(wǎng)絡(luò)司法拍賣因其具有成本低、效率高等特點(diǎn)而進(jìn)入人們的視野。在實(shí)踐中形成了以上海、重慶、浙江為代表的三種模式。目前我國網(wǎng)絡(luò)司法拍賣制度主要包括人民法院、網(wǎng)絡(luò)平臺的法律定位及責(zé)任承擔(dān)、拍賣程序、權(quán)利人的救濟(jì)途徑等內(nèi)容,但在實(shí)踐中還存在沉淀資金所有權(quán)及孳息歸屬不明、救濟(jì)權(quán)配置存在缺陷、評估和監(jiān)督機(jī)制不完善等問題。針對上述存在的問題,結(jié)合我國網(wǎng)絡(luò)司法拍賣制度的現(xiàn)狀,提出如下的完善建議:第一,明確規(guī)定沉淀資金及其孳息應(yīng)該歸屬于競拍者,但在返還孳息的做法上可以采取變通的方式。第二,完善救濟(jì)權(quán)配置。案外人財(cái)產(chǎn)被錯誤拍賣時,賦予其享有拍賣價金的返還請求權(quán)。拍定人所拍標(biāo)的物存在權(quán)利瑕疵,法院通過“公示公告”和“聲明不保證”主張免責(zé)時,應(yīng)當(dāng)分情況區(qū)別對待。第三,拍賣成交確認(rèn)書既不是合同的生效要件,也不是所有權(quán)轉(zhuǎn)移的依據(jù),應(yīng)當(dāng)予以摒棄,以拍賣裁定書來統(tǒng)一其效力。第四,在評估費(fèi)的收取方式上,引入錯誤邊際的概念。在監(jiān)督方式上,從人民法院內(nèi)部的分權(quán)與制衡、人民法院對網(wǎng)絡(luò)平臺的監(jiān)督、人民檢察院的事后監(jiān)督來進(jìn)行完善。
[Abstract]:With the gradual maturity of Internet technology and the popularization of network transactions, the network judicial auction has entered people's vision because of its low cost and high efficiency. In practice, the three models represented by Shanghai, Chongqing and Zhejiang are formed. At present, the network judicial auction system in China mainly includes the people's court and the legal system of the network platform. However, in practice, there are some problems in the practice, such as the ownership of the capital and the remedies, the defects in the allocation of remedies and the imperfect supervision mechanism. In view of the problems mentioned above, the following perfect construction is put forward in combination with the current situation of the system of network judicial auction in China. First, it is clear that the precipitated funds and their fruits should belong to the bidders, but the way of returning the fruits can be adopted. Second, improve the allocation of the right of relief. When the property of the case is wrongly auctioned, the right to return the auction price is given. Public notice "and" Declaration do not guarantee "should be treated differently when they advocate exemption. Third, the confirmation of an auction transaction is neither an effective element of the contract nor a basis for the transfer of ownership. It should be abandoned and the validity of an auction ruling is unify. Fourth, the concept of the error margin is introduced in the manner of collecting the evaluation fee. In the way of supervision, the people's court's supervision of the network platform and the post supervision of the people's Procuratorate are perfected from the decentralization and checks and balances within the people's court.
