【摘要】：最高人民檢察院力推的主任檢察官制度,旨在突破案件辦理的行政化,解決司法實踐中辦案效率低、案件質量不高、責任難以追究等問題。通過對試點檢察院的實證調研發(fā)現(xiàn),主任檢察官制度試行中存在主任檢察官定位不到位、檢察官獨立性有待進一步確立、部門人員設置存在重疊、職業(yè)保障不足等問題。應該從重新定位主任檢察官、確立檢察官獨立辦案地位、妥善安置部門負責人、重新界定檢察官辦案組性質等方面對主任檢察官制度進行重新定位;還應嚴格選任機制,健全人員分類管理體制,改革職業(yè)保障體制,健全監(jiān)督機制,進一步在立法上予以強化,進而保障制度得到真正的實行。
[Abstract]:The chief procurator system pushed by the Supreme people's Procuratorate aims to break through the administration of case handling and solve the problems such as low efficiency of handling cases, low quality of cases and difficulty in investigating responsibility in judicial practice. Through the empirical investigation of the pilot procuratorate, it is found that there are some problems in the trial of the chief procurator system, such as the localization of the chief procurator is not in place, the independence of the procurator needs to be further established, the personnel establishment of the department is overlapping, and the occupational security is The system of chief procurators should be reoriented from the aspects of repositioning the chief procurators, establishing the independent status of the procurators, properly placing the heads of departments, redefining the nature of the procurators' case handling teams, and also strictly selecting and appointing mechanisms. Improve the personnel classification management system, reform the occupational security system, improve the supervision mechanism, further strengthen the legislation, and then ensure the system has been truly implemented.
