【摘要】：正當前,我國瀆職犯罪案件審判中適用非監(jiān)禁刑過多的問題比較突出,嚴重影響了反腐敗斗爭的深入開展。對此,最高人民法院、最高人民檢察院于2012年下發(fā)了《關(guān)于辦理職務(wù)犯罪案件嚴格適用緩刑、免予刑事處罰若干問題的意見》。檢察機關(guān)反瀆職侵權(quán)部門有必要將深挖瀆職背后貪賄犯罪作為一個重要的辦案理念,推動案件偵查從"單罪名"向"多罪名"轉(zhuǎn)變,促進實刑判決率不斷提高,使反瀆工作實現(xiàn)法律效果、政治效果和社會效果的有機統(tǒng)一。
[Abstract]:At present, the problem of excessive application of non-custodial sentences in the trial of dereliction of duty crime cases in China is quite prominent, which seriously affects the in-depth development of the anti-corruption struggle. In view of this, the Supreme people's Court, On 2012, the Supreme people's Procuratorate issued a "strict application of probation in handling job-related crimes." Opinions on some issues concerning removal from Criminal punishment. It is necessary for the anti-malfeasance and tort department of the procuratorial organ to make the crime of bribery behind dereliction of duty an important concept of handling cases, and to promote the transformation of case investigation from "single charge" to "multi-charge". It promotes the rate of actual punishment judgment to improve continuously, and makes the anti-blasphemy work realize the organic unification of legal effect, political effect and social effect.
