【摘要】：清末以來,中國(guó)法律制度主要移植、模仿德日大陸法系,德日大陸法系實(shí)行公法人制度,其目的在于依法行政、保障私權(quán)安全,制約公權(quán)力擴(kuò)張,而且將包括律師公會(huì)在內(nèi)的民間團(tuán)體賦予行政職能,實(shí)行公法人化,在國(guó)家合法性監(jiān)督下,自負(fù)其責(zé)地執(zhí)行特定公共行政任務(wù)。受其影響,近代國(guó)家對(duì)律師公會(huì)進(jìn)行了一定程度上的公法人性質(zhì)建構(gòu),賦予一定的行政職能,在國(guó)家合法性監(jiān)督下實(shí)行自治行政。但由于該制度超前且不合時(shí)宜,而且沒有明確規(guī)定律師公會(huì)的公法人性質(zhì),導(dǎo)致其在實(shí)踐中無法厘清政府管理與行業(yè)自治的權(quán)力邊界。為因應(yīng)南京國(guó)民政府的"黨國(guó)體制"與"戰(zhàn)時(shí)體制",國(guó)家對(duì)律師公會(huì)行政授權(quán)后的"合法性監(jiān)督"在實(shí)踐中逐漸被"超法控制"所取代,律師公會(huì)的公法人性質(zhì)逐漸弱化。
[Abstract]:Since the end of the Qing Dynasty, China's legal system has been mainly transplanted, imitating the German and Japanese civil law systems, and implementing the public legal person system in order to administer according to law, to ensure the security of private rights and to restrict the expansion of public power. In addition, civil society, including the Bar Association, is entrusted with administrative functions and is made public and legalized, and under the supervision of the legitimacy of the State, it is responsible for carrying out certain public administration tasks... affected by it. In modern times, the law association was constructed as a public legal person to a certain extent, with certain administrative functions and autonomous administration under the supervision of state legitimacy. However, the system was advanced and out of date. Moreover, the nature of the Bar Association as a public legal person is not clearly defined, As a result, it is unable to clarify the power boundary between government management and industry autonomy in practice. In order to respond to the "Party and State system" and "wartime system" of the Nanjing National Government, the state supervises the legitimacy of the Bar Association after administrative authorization. In practice is gradually replaced by "super control", The public legal person nature of the Bar Association has gradually weakened.
