【摘要】：傳統法治思想是我國古代思想家和政治家思考治國理念、探索并實踐治國方式的經驗總結和智慧結晶,主要包括實行法治、如何實行法治以及法治與德治關系等思想。傳統法治思想經歷了一個長期發(fā)展演變的過程。近代以來,伴隨中國社會由傳統向現代的被動轉化,法治思想也隨之發(fā)生變化。在歷史新時期,堅持走中國特色社會主義法治道路,建設社會主義法治國家,推進法治中國建設,既要面向世界、認真學習和借鑒國外法治建設的有益經驗和積極成果,更要立足我國歷史文化傳統,深入挖掘和承繼中國優(yōu)秀傳統法治思想的重要資源。對傳統法治思想進行辯證分析及合理運用,不僅有助于吸取傳統法治思想的精華并發(fā)揮其積極作用,而且有助于結合新的歷史條件促進其創(chuàng)造性轉化。
[Abstract]:The traditional thought of rule of law is the thinking of ancient thinkers and statesmen of our country to think about the idea of governing the country, and to explore and practice the way of ruling the country with experience and wisdom. The traditional thought of rule of law has gone through a long-term development and evolution process. Since modern times, along with the passive transformation of Chinese society from tradition to modern, the thought of rule of law has also changed. In the new era of history, to adhere to the rule of law road of socialism with Chinese characteristics, to build a socialist country ruled by law, and to promote the construction of China ruled by law, we should not only face the world, seriously study and draw lessons from the beneficial experience and positive achievements of foreign rule of law construction, Moreover, based on the historical and cultural tradition of our country, we should deeply excavate and inherit the important resources of China's outstanding traditional thought of rule of law. The dialectical analysis and rational application of the traditional thought of rule by law will not only help to absorb the essence of the thought of traditional rule of law and play its positive role, but also help to promote its creative transformation in combination with new historical conditions.
