【摘要】： “慎刑”思想是我國古代先哲留給后人的重要思想財(cái)富,是中國儒家思想的重要部分。儒家思想強(qiáng)調(diào)仁治,反對(duì)濫施刑罰、“不教而誅”,要求統(tǒng)治者做到慎罰恤刑。唐王朝是我國封建時(shí)代的全盛時(shí)期,唐代的政治、經(jīng)濟(jì)、文化等各方面都發(fā)展到了相當(dāng)?shù)母叨�。唐代的社�?huì)也顯示出了相當(dāng)高的開放性。統(tǒng)治者追求進(jìn)取,社會(huì)政治也相對(duì)清明,慎刑思想在唐代也得到了極大的發(fā)展和良好的貫徹。通過對(duì)唐代慎刑思想及慎刑制度的研究,可以更好更充分的了解我國古代的慎刑思想。通過研究唐代慎刑思想緣何得到良好貫徹,從而了解我國古代慎刑思想的真諦,以及慎刑制度在古代現(xiàn)實(shí)社會(huì)當(dāng)中的實(shí)際運(yùn)行狀態(tài)。分析在我國古代“人治”模式下,“慎刑”作用與實(shí)際效果。
[Abstract]:The thought of careful punishment is an important ideological wealth left by ancient Chinese philosophers and an important part of Chinese Confucianism. Confucianism emphasizes benevolence, opposes the abuse of punishment, and requires rulers to be careful in penalizing and compassionate punishment. The Tang Dynasty was the heyday of the feudal era in China, and the political, economic and cultural aspects of the Tang Dynasty developed to a considerable height. The society of Tang Dynasty also showed quite high openness. Rulers pursue enterprising, social politics is relatively clear, careful punishment thought in the Tang Dynasty has been a great development and good implementation. Through the study of the thought of careful punishment and the system of careful punishment in Tang Dynasty, we can better and more fully understand the thought of careful punishment in ancient China. In order to understand the true meaning of the thought of careful punishment in ancient China and the actual running state of the system of careful punishment in ancient society, the author studies why the thought of careful punishment was carried out well in the Tang Dynasty. This paper analyzes the function and practical effect of "careful punishment" under the mode of "rule by man" in ancient China.
