【摘要】：明末清初是中國(guó)封建社會(huì)一個(gè)大動(dòng)蕩的時(shí)期，社會(huì)政治經(jīng)濟(jì)領(lǐng)域出現(xiàn)的新情況，使得這一時(shí)期的中國(guó)思想界呈現(xiàn)出異彩紛呈的景象。諸多的思想家和學(xué)者心懷天下，關(guān)心國(guó)事，對(duì)當(dāng)時(shí)的政治、經(jīng)濟(jì)、法律制度等各方面提出了自己的見(jiàn)解和主張。唐甄就是他們之中的一位，他目睹了當(dāng)時(shí)社會(huì)的大動(dòng)亂，心憂百姓，立志為天子立言，為生民立命，在政治、經(jīng)濟(jì)、法律思想等方面都有系統(tǒng)的觀點(diǎn)和論證。 學(xué)術(shù)界對(duì)唐甄政治、經(jīng)濟(jì)、哲學(xué)思想的研究已經(jīng)取得了很多成果，但是對(duì)其法律思想的詳細(xì)考證和論述卻著墨較少；為此，本文作者以唐甄的傳世著作《潛書》為基礎(chǔ)，試圖在充分總結(jié)前人研究成果的基礎(chǔ)上對(duì)唐甄的法律思想進(jìn)行系統(tǒng)的整理和論述。在本文的寫作過(guò)程中，筆者仔細(xì)考證和論述了唐甄的法律思想產(chǎn)生的時(shí)代背景以及哲學(xué)基礎(chǔ)，對(duì)其“宗法”思想進(jìn)行了梳理，按照現(xiàn)代法學(xué)部門法法理學(xué)、經(jīng)濟(jì)法學(xué)、行政法學(xué)、訴訟法學(xué)的分類，詳盡的闡明了唐甄在各領(lǐng)域的法律思想，并且把唐甄的法律思想與其同時(shí)代的黃宗羲、王夫之、顧炎武的法律思想進(jìn)行了比較；最后，筆者站在歷史的高度，對(duì)唐甄的法律思想進(jìn)行了客觀的評(píng)價(jià)，并闡釋其對(duì)當(dāng)今社會(huì)法治建設(shè)的啟示。唐甄作為明末清初的進(jìn)步思想家，其法律思想繼承了我國(guó)古代傳統(tǒng)政法思想的內(nèi)容，，又帶有鮮明的時(shí)代特色，研究其法律思想對(duì)于當(dāng)今構(gòu)建社會(huì)主義法治社會(huì)有很大的啟示意義。但是“長(zhǎng)夜難明赤縣之天”，囿于時(shí)代和階級(jí)的局限，他最終沒(méi)能沖破歷史的藩籬，許多具有借鑒性的制度和思想只停留在了書面上，但這絲毫不影響唐甄在思想史上的地位。本文通過(guò)對(duì)其法律思想的總結(jié)和概括，力求能夠全面、真實(shí)、客觀的還原唐甄心目中的法律理想國(guó)。
[Abstract]:The late Ming and early Qing dynasties were a period of great turbulence in the feudal society of China. The new situation in the field of social politics and economy made the Chinese ideological circles in this period present a colorful scene. Many thinkers and scholars were concerned about state affairs and put forward their own opinions and opinions on politics, economy, legal system and so on. Tang Zhen was one of them. He witnessed the social turmoil, worried about the people, determined to stand for the son of Heaven, for the people to live, in the political, economic, legal and other aspects of the views and arguments. Many achievements have been made in the research of Tang Zhen's political, economic and philosophical thoughts, but the detailed textual research and argumentation of his legal thought are less. Therefore, on the basis of Tang Zhen's handed down book, the author tries to make a systematic arrangement and discussion of Tang Zhen's legal thought on the basis of summing up the previous research results. In the process of writing, the author carefully studies and discusses the background and philosophical basis of Tang Zhen's legal thought, and combs his "patriarchal clan" thought, according to modern jurisprudence, economic law. The classification of administrative law and procedural law elaborates Tang Zhen's legal thoughts in various fields, and compares Tang Zhen's legal thoughts with those of Huang Zongxi, Wang Fuzhi and Gu Yanwu. Finally, from the historical perspective, the author evaluates Tang Zhen's legal thought objectively and explains its enlightenment to the construction of the rule of law in the society today. As a progressive thinker in the late Ming and early Qing dynasties, Tang Zhen's legal thought inherited the contents of the traditional political and legal thoughts of ancient China, and had distinctive characteristics of the times. The study of its legal thought is of great significance to the construction of socialist society ruled by law. However, due to the limitations of the times and classes, he was unable to break through the historical barriers, and many systems and ideas with reference only stayed in writing, but this did not affect Tang Zhen's position in the history of thought. By summing up and summarizing his legal thought, this paper tries to restore Tang Zhen's ideal country of law comprehensively, truthfully and objectively.
