【摘要】：宋代民事息訟在司法中運(yùn)用之廣、方式之多是前所未有的。其主要類型有:化解紛爭(zhēng)的財(cái)產(chǎn)息訟、辨析倫理的人倫息訟、敦厚宗族的立繼息訟、和睦家庭的婚姻息訟。在息訟中,宋代司法官吏追求民事訴訟的終結(jié),采取了整體性的審判思維,靈活運(yùn)用息訟方式化解各種民事糾紛。宋代富有特色的民事息訟方式在完善民事訴訟程序、保護(hù)民事權(quán)利、緩解家庭和社會(huì)矛盾、促進(jìn)社會(huì)穩(wěn)定和諧等方面起著重要的作用。
[Abstract]:In the Song Dynasty, civil interest litigation was widely used in the administration of justice, and the way was unprecedented. The main types of litigation are: resolving disputes of property litigation, discriminating and analyzing the ethics of the people interest litigation, Dunhou clan of the continuation of litigation, harmonious family marriage interest litigation. In the interest litigation, the judicial officials of the Song Dynasty pursued the end of the civil action, took the holistic trial thinking, and solved various civil disputes flexibly by the way of interest litigation. The characteristic way of civil litigation in Song Dynasty plays an important role in perfecting civil procedure, protecting civil rights, alleviating family and social contradictions and promoting social stability and harmony.
