【摘要】： 本文以韓禮德的語法隱喻理論為研究框架,探討和分析了合同語言中的語法隱喻現(xiàn)象。 傳統(tǒng)隱喻理論將隱喻看成修辭手法或是詞匯和句子層面上的轉(zhuǎn)換。韓禮德則認(rèn)為隱喻是在詞匯語法層面上的轉(zhuǎn)換,并由此提出了語法隱喻的概念,從不同的角度詮釋隱喻。韓禮德成功運(yùn)用語法隱喻分析科學(xué)語篇后,語法隱喻被大量運(yùn)用到對(duì)科學(xué)語篇、新聞?wù)Z篇及法律語篇的解構(gòu)中。 合同是最重要的法律文書之一,在各種商務(wù)和社會(huì)活動(dòng)中起到重要的法律保障作用。因此,對(duì)于合同語言的研究一直以來都引起各界學(xué)者廣泛關(guān)注。但目前的研究大多是集中在合同措辭,用語,句子結(jié)構(gòu)等方面,而鮮有從合同語言的詞匯語法層面進(jìn)行探討。所以本文以其他學(xué)者對(duì)合同語言的研究為基礎(chǔ),以韓禮德對(duì)語法隱喻的重新分類為框架,對(duì)合同語言進(jìn)行語法隱喻分析并總結(jié)語法隱喻在合同語言中所起到的作用。本文采取定性和定量相結(jié)合的方法,以四類最常見的合同文本為語料進(jìn)行分析。 本文分析結(jié)果顯示,語法隱喻在合同語言中是普遍存在的。名詞性隱喻對(duì)合同語言特點(diǎn)的形成起到最為重要的作用。語法隱喻使得合同語言具有凝練,客觀和權(quán)威的特點(diǎn)。
[Abstract]:Based on Hallidy's theory of grammatical metaphor, this paper explores and analyzes grammatical metaphor in contract language.
In the traditional metaphor theory, metaphor is regarded as a rhetorical device or a conversion on the vocabulary and sentence level. Hallidy believes that metaphor is a conversion on the grammatical level of vocabulary, and thus puts forward the concept of grammatical metaphor and interprets metaphor from different angles. After the successful application of grammatical metaphor to the analysis of a scientific text, the grammatical metaphor is used in large quantities by Hallidy. To deconstruct scientific discourse, news discourse and legal discourse.
Contract is one of the most important legal documents and plays an important role in legal protection in all kinds of business and social activities. Therefore, the study of contract language has always attracted wide attention of scholars from all walks of life. But most of the current research is focused on the terms of contract, language, sentence structure and so on, but there are few words from the contract language. On the basis of the grammatical level, this paper, based on the study of the contract language by other scholars, takes Hallidy's reclassification of grammatical metaphor as the framework, analyzes the grammatical metaphor of the contract language and summarizes the role of grammatical metaphor in the contract language. This article adopts the method of combining the definite and the quantitative, which is the most common in the four categories. The text of the contract is analyzed for the corpus.
The analysis shows that grammatical metaphor is common in contract language. Noun metaphor plays the most important role in the formation of contract language characteristics. Grammatical metaphor makes the contract language characterized by concise, objective and authoritative.
