【摘要】：重新理解中國(guó)傳統(tǒng)的社會(huì)解紛機(jī)制,在中國(guó)現(xiàn)代法治框架下,發(fā)掘傳統(tǒng)文化的優(yōu)秀基因,生成符合社會(huì)內(nèi)在機(jī)理的法治新模式意義重大。豐富的訴訟外社會(huì)解紛機(jī)制是中國(guó)古代法制的重要特色,這種社會(huì)性糾紛解決機(jī)制不僅表現(xiàn)為解紛主體多元化,而且表現(xiàn)為解紛機(jī)制的多元化。注重多元化的社會(huì)解紛機(jī)制是中國(guó)古代社會(huì)普遍的社會(huì)生活現(xiàn)象,是中國(guó)傳統(tǒng)社會(huì)法律的顯著特點(diǎn),也是中國(guó)古代法的光輝所在。
[Abstract]:It is of great significance to re-understand the traditional social dispute resolution mechanism in the framework of Chinese modern rule of law to discover the excellent genes of traditional culture and to create a new model of rule of law that conforms to the inherent mechanism of society. The rich social dispute resolution mechanism outside litigation is an important feature of the ancient Chinese legal system. This kind of social dispute resolution mechanism is not only the diversification of the main body of dispute resolution, but also the diversification of the dispute resolution mechanism. It is a common phenomenon of social life in ancient China to pay attention to the pluralistic social solution mechanism. It is a remarkable feature of Chinese traditional social law and a glorious place of ancient Chinese law.
