【摘要】："禮不下庶人刑不上大夫"不連讀,兩者涉及兩種不同的儀禮。因為庶人無廟,故其君、上軾廟時不必下車回避,此即"禮不下庶人"。君使臣以禮,會見大臣當以禮意而非刑意,故"刑人不在君側"。自賈誼在《新書.階級》中以"禮不及庶人,刑不至大夫"對之加以闡釋后,所引起的爭論迄今未決。在承認"禮不及庶人,刑不至大夫"的前提下,通過對"禮"、"刑"的外延加以限制,將之修訂為"某些或某種禮不及庶人,某些或某種刑不至大夫",這種說法在邏輯上是不通的;而據此否認"禮不下庶人,刑不上大夫"是真實存在過的制度,其觀點雖有可取,但仍然存在前提性錯誤;"刑無等級"比"禮有等級"更專制。
