加強(qiáng)主體功能區(qū)法制建設(shè)芻議

【摘要】:推進(jìn)形成主體功能區(qū)的重中之重在于法律政策。"十二五"規(guī)劃明確提出要基本形成適應(yīng)主體功能區(qū)要求的法律、法規(guī)、政策和規(guī)劃體系。目前,我國(guó)有關(guān)主體功能區(qū)的法律政策還存在一定的立法盲區(qū)。應(yīng)更新法制理念,重點(diǎn)圍繞主體功能區(qū)立法與法律的統(tǒng)一性和穩(wěn)定性相協(xié)調(diào)、主體功能區(qū)法律在適用范圍上與地方行政區(qū)的關(guān)系、主體功能區(qū)的立法手段如何保證中央財(cái)政支付轉(zhuǎn)移和多層次區(qū)級(jí)利益補(bǔ)償機(jī)制實(shí)現(xiàn)等,切實(shí)加強(qiáng)主體功能區(qū)法制建設(shè)。
[Abstract]:The most important thing in promoting the formation of the main function area lies in the law and policy. " The 12th Five-Year Plan clearly states that laws, regulations, policies and planning systems should be formed to meet the requirements of the main functional areas. At present, there are still some legislative blind areas in our country. We should renew the concept of legal system, focus on the coordination of the unity and stability of the legislation and the law of the main function area, and the relationship between the law of the main function area and the local administrative region in the scope of application. How to ensure the transfer of central finance payment and the realization of multi-level benefit compensation mechanism in the main function area, and how to strengthen the legal system construction of the main function area.
