【摘要】： 人類文明經(jīng)歷了由農(nóng)業(yè)文明到商業(yè)文明的變遷,相應(yīng)地,法律與道德關(guān)系也經(jīng)歷了一個由“法律的道德化”向“法律的去道德化”的轉(zhuǎn)變,梅因?qū)⑦@一轉(zhuǎn)變稱之為“從身份到契約”。 家庭和氏族是農(nóng)業(yè)社會的基本單元,“血緣”是家庭和氏族成員關(guān)系的紐帶,而道德便是由這種“血緣”紐帶演化而來的。因此,道德是農(nóng)業(yè)文明用以維持社會關(guān)系和社會秩序的主要規(guī)范,而這時的法律也總是一種道德化的法律。在商業(yè)社會,人脫離了身份、地位等“道德”因素的束縛,在陌生的關(guān)系中人是理性的“經(jīng)濟人”,人與人依靠“契約”連系著。理性化的生活造就了多元化的“新道德”和形式化的法律,“新道德”不再具有規(guī)制人與人關(guān)系的普遍性的功能,而法律祛除了傳統(tǒng)道德的影響而成為規(guī)制人與人關(guān)系的形式化及普遍適用的規(guī)范。同時,商業(yè)社會中由于“經(jīng)濟人”的“理性”使得法律不得不考慮“新道德”的要求。 本文通過對西方社會從農(nóng)業(yè)文明向商業(yè)文明的轉(zhuǎn)化過程的探討,試圖揭示法律與道德在這一轉(zhuǎn)變過程中生成的新內(nèi)涵及二者關(guān)系的新變化,以期正確認(rèn)識當(dāng)代中國法治秩序的性質(zhì)及未來的走向。
[Abstract]:Human civilization has undergone a transition from agricultural civilization to commercial civilization. Accordingly, the relationship between law and morality has also undergone a transformation from "the moralization of law" to "de-moralization of law". Maine called the transition "from identity to contract." Family and clan are the basic unit of agricultural society, "blood" is the bond between family and clan members, and morality is derived from this "blood" bond. Morality is the main norm used by agricultural civilization to maintain social relations and social order. At this time, the law is always a kind of moral law. In the commercial society, people are separated from the shackles of "moral" factors such as identity and status. In a strange relationship, man is a rational "economic man", and people depend on "contract" to connect. Rational life has created diversified "new morality" and formalized law, "new morality" no longer has the regulation between people and people. The universal function of the Department, The law dispels the influence of traditional morality and becomes the formalization and universal norm of regulating the relationship between people. At the same time, due to the "rationality" of "economic man" in commercial society, the law has to consider the requirement of "new morality". This paper attempts to reveal the new connotation of law and morality in the process of transformation from agricultural civilization to commercial civilization, and the new changes in the relationship between the two, through the discussion of the transformation process of western society from agricultural civilization to commercial civilization. In order to correctly understand the nature of contemporary China's legal order and the future trend.
